一、審理農(nong)村集體土地(di)征收補償案件的突出問(wen)題有哪些?

農(nong)村集(ji)體土(tu)地(di)征收(shou)(shou)所引(yin)發的行(xing)政(zheng)案件(jian),是當(dang)前行(xing)政(zheng)案件(jian)的主要類型。一(yi)方面(mian), 此類案件(jian)事關被(bei)征地(di)農(nong)民切身重(zhong)大利益,矛(mao)盾(dun)易激(ji)化,糾紛周期(qi)長(chang),化解難(nan)度(du)大,社會(hui)關注(zhu)度(du)高。另一(yi)方面(mian),由于(yu)現行(xing)法(fa)律法(fa)規有關農(nong)村集(ji)體土(tu)地(di)征收(shou)(shou)的規定較為(wei)原則,且部分規定明顯滯后,補(bu)償(chang)標準和范圍確定與計算方式不合理,征收(shou)(shou)與補(bu)償(chang)程序制度(du)不完善(shan)等,導致(zhi)被(bei)征地(di)農(nong)民的知情權、參(can)與權、表達權和監督權未能得到充分尊重(zhong),人民法(fa)院司法(fa)監督難(nan)度(du)大。

巡(xun)回區各級(ji)人民法院要更(geng)多(duo)通過“走出去”和(he)(he)“請進來(lai)”等方式,加強與政(zheng)府法制(zhi)部(bu)門(men)和(he)(he)土(tu)地(di)(di)行政(zheng)主(zhu)管部(bu)門(men)的溝通交流,及時就(jiu)征(zheng)收補(bu)償政(zheng)策完(wan)善(shan)提出意見和(he)(he)建議(yi),填補(bu)政(zheng)策漏洞,規范(fan)征(zheng)收補(bu)償程序,共同(tong)為地(di)(di)方性政(zheng)策的合(he)法化、規范(fan)化和(he)(he)具體化作(zuo)出貢獻(xian)。巡(xun)回區條件成熟的中(zhong)、高級(ji)人民法院,還可(ke)以成立專業化合(he)議(yi)庭,集中(zhong)審理土(tu)地(di)(di)征(zheng)收補(bu)償案件,為完(wan)善(shan)土(tu)地(di)(di)征(zheng)收補(bu)償制(zhi)度積累(lei)好(hao)經驗、好(hao)做(zuo)法。

四、征收補(bu)償中哪些行(xing)為屬(shu)于(yu)可訴行(xing)政行(xing)為,被征收人告(gao)什(shen)么、如何告(gao)、哪個階段告(gao)?

土地(di)征(zheng)收補償(chang)是(shi)典型(xing)的(de)多(duo)(duo)(duo)主體(ti)、多(duo)(duo)(duo)階(jie)段、多(duo)(duo)(duo)環節、多(duo)(duo)(duo)個行(xing)(xing)(xing)政(zheng)(zheng)行(xing)(xing)(xing)為前(qian)(qian)后(hou)(hou)延(yan)續交(jiao)織的(de)復合(he)程(cheng)序,包(bao)括征(zheng)地(di)批前(qian)(qian)階(jie)段、組卷報批階(jie)段和批準后(hou)(hou)實(shi)施(shi)階(jie)段。其中,可(ke)訴(su)與不可(ke)訴(su)行(xing)(xing)(xing)政(zheng)(zheng)行(xing)(xing)(xing)為如(ru)何區(qu)分,起訴(su)時機是(shi)否成熟、審理后(hou)(hou)階(jie)段行(xing)(xing)(xing)政(zheng)(zheng)行(xing)(xing)(xing)為時是(shi)否需要繼續審查先(xian)前(qian)(qian)行(xing)(xing)(xing)政(zheng)(zheng)行(xing)(xing)(xing)為,各地(di)有關征(zheng)地(di)補償(chang)步驟程(cheng)序也不完(wan)全一致。人民法(fa)院應當在既有法(fa)律(lv)規定框架(jia)內,結合(he)具體(ti)實(shi)踐,科(ke)學界定可(ke)訴(su)行(xing)(xing)(xing)政(zheng)(zheng)行(xing)(xing)(xing)為類型(xing),注重實(shi)質性化解補償(chang)安置糾紛。

(一)省級人民政府征地批復原則上(shang)暫不可訴(su),但已(yi)經受理的可以繼續探索并積累經驗

根據司法(fa)(fa)部國法(fa)(fa)〔2014〕40號《關于認定(ding)(ding)被征(zheng)地(di)(di)(di)農(nong)民(min)(min)“知(zhi)道”征(zheng)收(shou)土(tu)地(di)(di)(di)決定(ding)(ding)的(de)(de)意見》的(de)(de)表(biao)述,省(sheng)級(ji)(ji)(ji)(ji)人(ren)(ren)(ren)(ren)民(min)(min)政(zheng)(zheng)府應當作出(chu)征(zheng)收(shou)土(tu)地(di)(di)(di)決定(ding)(ding),但實(shi)(shi)踐(jian)中不論是(shi)立法(fa)(fa)還(huan)是(shi)實(shi)(shi)踐(jian),省(sheng)級(ji)(ji)(ji)(ji)人(ren)(ren)(ren)(ren)民(min)(min)政(zheng)(zheng)府均未作出(chu)“征(zheng)收(shou)土(tu)地(di)(di)(di)決定(ding)(ding)”。目(mu)(mu)前巡回區各地(di)(di)(di)省(sheng)級(ji)(ji)(ji)(ji)人(ren)(ren)(ren)(ren)民(min)(min)政(zheng)(zheng)府征(zheng)收(shou)土(tu)地(di)(di)(di)決定(ding)(ding)通常被表(biao)述為征(zheng)地(di)(di)(di)批(pi)復(fu)(fu)(fu)(fu),且征(zheng)地(di)(di)(di)批(pi)復(fu)(fu)(fu)(fu)的(de)(de)具體(ti)名(ming)稱(cheng)(cheng)和表(biao)現形式不同(tong),有(you)的(de)(de)稱(cheng)(cheng)為“批(pi)復(fu)(fu)(fu)(fu)”,有(you)的(de)(de)稱(cheng)(cheng)為“建設用(yong)地(di)(di)(di)審(shen)批(pi)意見書”,有(you)的(de)(de)稱(cheng)(cheng)為“年度批(pi)次(ci)村鎮建設用(yong)地(di)(di)(di)的(de)(de)批(pi)復(fu)(fu)(fu)(fu)”,還(huan)有(you)的(de)(de)與(yu)農(nong)用(yong)地(di)(di)(di)轉用(yong)手續相合(he)并。征(zheng)地(di)(di)(di)批(pi)復(fu)(fu)(fu)(fu)對象既非被征(zheng)收(shou)土(tu)地(di)(di)(di)所(suo)有(you)權人(ren)(ren)(ren)(ren),也非具體(ti)實(shi)(shi)施的(de)(de)市(shi)、縣人(ren)(ren)(ren)(ren)民(min)(min)政(zheng)(zheng)府,而(er)是(shi)地(di)(di)(di)級(ji)(ji)(ji)(ji)市(shi)人(ren)(ren)(ren)(ren)民(min)(min)政(zheng)(zheng)府;除單(dan)獨選址項(xiang)目(mu)(mu)征(zheng)地(di)(di)(di)以(yi)(yi)外(wai),批(pi)復(fu)(fu)(fu)(fu)內容一(yi)般按(an)本年度批(pi)次(ci)建設用(yong)地(di)(di)(di)審(shen)批(pi)而(er)非按(an)項(xiang)目(mu)(mu)審(shen)批(pi),批(pi)復(fu)(fu)(fu)(fu)內容十分(fen)籠統(tong),多涉及多個地(di)(di)(di)塊。對此類省(sheng)級(ji)(ji)(ji)(ji)人(ren)(ren)(ren)(ren)民(min)(min)政(zheng)(zheng)府征(zheng)地(di)(di)(di)批(pi)復(fu)(fu)(fu)(fu)可訴(su)性,目(mu)(mu)前仍有(you)一(yi)定(ding)(ding)分(fen)歧。結合(he)《中華(hua)人(ren)(ren)(ren)(ren)民(min)(min)共(gong)和國行(xing)(xing)政(zheng)(zheng)訴(su)訟法(fa)(fa)》現有(you)規(gui)定(ding)(ding)以(yi)(yi)及《中華(hua)人(ren)(ren)(ren)(ren)民(min)(min)共(gong)和國行(xing)(xing)政(zheng)(zheng)復(fu)(fu)(fu)(fu)議法(fa)(fa)》修(xiu)改方向來(lai)看,顯然屬(shu)于可訴(su)范圍(wei)。但在《中華(hua)人(ren)(ren)(ren)(ren)民(min)(min)共(gong)和國行(xing)(xing)政(zheng)(zheng)復(fu)(fu)(fu)(fu)議法(fa)(fa)》第30條(tiao)未修(xiu)訂前,各地(di)(di)(di)可以(yi)(yi)結合(he)本地(di)(di)(di)實(shi)(shi)際(ji)自(zi)行(xing)(xing)探索,自(zi)行(xing)(xing)決定(ding)(ding)是(shi)否納入受案(an)范圍(wei)。

(二)農村集體(ti)土地征收(shou)補償的基(ji)本步驟

根據(ju)《中華(hua)人民共和(he)國土(tu)地(di)(di)管(guan)理法(fa)(fa)(fa)》《中華(hua)人民共和(he)國土(tu)地(di)(di)管(guan)理法(fa)(fa)(fa)實施條例(li)》以及《征(zheng)收(shou)(shou)土(tu)地(di)(di)公告辦法(fa)(fa)(fa)》等規定,參考國務(wu)院法(fa)(fa)(fa)制(zhi)辦國法(fa)(fa)(fa)〔2011〕35號《關于(yu)依(yi)法(fa)(fa)(fa)做(zuo)好征(zheng)地(di)(di)補(bu)償(chang)(chang)(chang)安(an)(an)置爭議行(xing)政(zheng)復議工(gong)作的通(tong)知》精神(shen),在(zai)收(shou)(shou)到國務(wu)院或(huo)者省級人民政(zheng)府征(zheng)地(di)(di)批復后,農村集體(ti)土(tu)地(di)(di)征(zheng)收(shou)(shou)補(bu)償(chang)(chang)(chang)程序(xu)可以分(fen)為“征(zheng)收(shou)(shou)土(tu)地(di)(di)公告”環(huan)節、“征(zheng)地(di)(di)補(bu)償(chang)(chang)(chang)登記”環(huan)節、“征(zheng)地(di)(di)補(bu)償(chang)(chang)(chang)安(an)(an)置方(fang)案(an)聽取(qu)意見、批準(zhun)與(yu)公告”環(huan)節、“按照(zhao)征(zheng)地(di)(di)補(bu)償(chang)(chang)(chang)安(an)(an)置方(fang)案(an)向權利人支付補(bu)償(chang)(chang)(chang)項(xiang)目”環(huan)節,“不按照(zhao)依(yi)法(fa)(fa)(fa)批準(zhun)的方(fang)案(an)進行(xing)補(bu)償(chang)(chang)(chang)安(an)(an)置引發爭議依(yi)法(fa)(fa)(fa)申請復議或(huo)訴訟”環(huan)節、“責(ze)令(ling)交出土(tu)地(di)(di)”以及申請法(fa)(fa)(fa)院強制(zhi)執行(xing)等環(huan)節。

具(ju)體如(ru)(ru)下(xia):一是,市、縣(xian)(xian)人民(min)政府應當(dang)在收(shou)到征(zheng)(zheng)(zheng)(zheng)收(shou)土(tu)(tu)(tu)地(di)(di)(di)(di)方案批準(zhun)(zhun)文(wen)件之日(ri)起10個工作日(ri)內(nei)進行(xing)征(zheng)(zheng)(zheng)(zheng)收(shou)土(tu)(tu)(tu)地(di)(di)(di)(di)公(gong)告,該市、縣(xian)(xian)人民(min)政府土(tu)(tu)(tu)地(di)(di)(di)(di)行(xing)政主管(guan)部門(men)負責(ze)具(ju)體實施。征(zheng)(zheng)(zheng)(zheng)收(shou)土(tu)(tu)(tu)地(di)(di)(di)(di)公(gong)告應當(dang)包括下(xia)列內(nei)容(rong):①征(zheng)(zheng)(zheng)(zheng)地(di)(di)(di)(di)批準(zhun)(zhun)機關、批準(zhun)(zhun)文(wen)號、批準(zhun)(zhun)時間和(he)批準(zhun)(zhun)用途(tu);②被征(zheng)(zheng)(zheng)(zheng)收(shou)土(tu)(tu)(tu)地(di)(di)(di)(di)的(de)所有權人、位置(zhi)、地(di)(di)(di)(di)類(lei)和(he)面積;③征(zheng)(zheng)(zheng)(zheng)地(di)(di)(di)(di)補(bu)(bu)(bu)償(chang)標(biao)準(zhun)(zhun)和(he)農(nong)(nong)(nong)業(ye)人員安置(zhi)途(tu)徑;④辦(ban)理(li)征(zheng)(zheng)(zheng)(zheng)地(di)(di)(di)(di)補(bu)(bu)(bu)償(chang)登記的(de)期(qi)限、地(di)(di)(di)(di)點(dian)。被征(zheng)(zheng)(zheng)(zheng)地(di)(di)(di)(di)農(nong)(nong)(nong)村集體經(jing)濟(ji)組織、農(nong)(nong)(nong)村村民(min)或者其他權利(li)人應當(dang)在征(zheng)(zheng)(zheng)(zheng)收(shou)土(tu)(tu)(tu)地(di)(di)(di)(di)公(gong)告規(gui)定的(de)期(qi)限內(nei)持(chi)土(tu)(tu)(tu)地(di)(di)(di)(di)權屬證書到指定地(di)(di)(di)(di)點(dian)辦(ban)理(li)征(zheng)(zheng)(zheng)(zheng)地(di)(di)(di)(di)補(bu)(bu)(bu)償(chang)登記手(shou)續(xu)。被征(zheng)(zheng)(zheng)(zheng)地(di)(di)(di)(di)農(nong)(nong)(nong)村集體經(jing)濟(ji)組織、農(nong)(nong)(nong)村村民(min)或者其他權利(li)人未如(ru)(ru)期(qi)辦(ban)理(li)征(zheng)(zheng)(zheng)(zheng)地(di)(di)(di)(di)補(bu)(bu)(bu)償(chang)登記手(shou)續(xu)的(de),其補(bu)(bu)(bu)償(chang)內(nei)容(rong)以(yi)有關市、縣(xian)(xian)土(tu)(tu)(tu)地(di)(di)(di)(di)行(xing)政主管(guan)部門(men)的(de)調查結果為(wei)準(zhun)(zhun)。

二(er)是,有關(guan)市、縣人(ren)(ren)民政(zheng)府土(tu)(tu)地(di)(di)行政(zheng)主管部門會同有關(guan)部門根據批準(zhun)(zhun)的(de)征收土(tu)(tu)地(di)(di)方案(an)(an),在征收土(tu)(tu)地(di)(di)公告(gao)之日起(qi)45日內(nei)以被征收土(tu)(tu)地(di)(di)的(de)所有權人(ren)(ren)為單位擬訂征地(di)(di)補償、安(an)置(zhi)方案(an)(an)并(bing)予以公告(gao)。征地(di)(di)補償安(an)置(zhi)方案(an)(an)公告(gao)應當包括(kuo)下列內(nei)容(rong):①本集體經濟組織被征收土(tu)(tu)地(di)(di)的(de)位置(zhi)、地(di)(di)類、面積,地(di)(di)上(shang)附著物(wu)(含房屋等,下同)和(he)青(qing)苗的(de)種類、數(shu)量,需(xu)要安(an)置(zhi)的(de)農(nong)業(ye)人(ren)(ren)口的(de)數(shu)量;②土(tu)(tu)地(di)(di)補償費(fei)(fei)的(de)標(biao)準(zhun)(zhun)、數(shu)額、支(zhi)(zhi)付對象(xiang)和(he)支(zhi)(zhi)付方式;③安(an)置(zhi)補助(zhu)費(fei)(fei)的(de)標(biao)準(zhun)(zhun)、數(shu)額、支(zhi)(zhi)付對象(xiang)和(he)支(zhi)(zhi)付方式;④地(di)(di)上(shang)附著物(wu)和(he)青(qing)苗的(de)補償標(biao)準(zhun)(zhun)和(he)支(zhi)(zhi)付方式;⑤農(nong)業(ye)人(ren)(ren)員的(de)具(ju)體安(an)置(zhi)途(tu)徑;⑥其(qi)他有關(guan)征地(di)(di)補償、安(an)置(zhi)的(de)具(ju)體措(cuo)施。

三(san)是,市(shi)、縣(xian)人民(min)政府(fu)土地(di)(di)行政主(zhu)管部門(men)按照征(zheng)(zheng)地(di)(di)補(bu)償(chang)安置(zhi)(zhi)方案(an)組(zu)織(zhi)(zhi)(zhi)實施。將征(zheng)(zheng)地(di)(di)補(bu)償(chang)、安置(zhi)(zhi)費用撥付給被征(zheng)(zheng)地(di)(di)農(nong)村集體經濟(ji)(ji)組(zu)織(zhi)(zhi)(zhi)后(hou),有(you)權要求該農(nong)村集體經濟(ji)(ji)組(zu)織(zhi)(zhi)(zhi)在一定時限內提供支付清單(dan)。市(shi)、縣(xian)人民(min)政府(fu)土地(di)(di)行政主(zhu)管部門(men)有(you)權督促有(you)關農(nong)村集體經濟(ji)(ji)組(zu)織(zhi)(zhi)(zhi)將征(zheng)(zheng)地(di)(di)補(bu)償(chang)、安置(zhi)(zhi)費用收支狀況(kuang)向本集體經濟(ji)(ji)組(zu)織(zhi)(zhi)(zhi)成員予以公布,以便被征(zheng)(zheng)地(di)(di)農(nong)村集體經濟(ji)(ji)組(zu)織(zhi)(zhi)(zhi)、農(nong)村村民(min)或(huo)者其他權利人查詢和監督。

四是,因未(wei)(wei)按(an)照依法(fa)批準的(de)征收土(tu)地(di)(di)方(fang)案(an)和征地(di)(di)補償(chang)、安置(zhi)方(fang)案(an)進行補償(chang)、安置(zhi)引發(fa)爭議的(de),先(xian)由市(shi)、縣(xian)人(ren)民(min)政府(fu)協(xie)調,協(xie)調不(bu)成的(de),權利人(ren)認為市(shi)、縣(xian)人(ren)民(min)政府(fu)未(wei)(wei)依法(fa)進行安置(zhi)補償(chang)的(de),可以向地(di)(di)級市(shi)人(ren)民(min)政府(fu)申請(qing)(qing)(qing)復(fu)(fu)議后(或者)直(zhi)接(jie)提起(qi)(qi)訴訟,或者向人(ren)民(min)法(fa)院提起(qi)(qi)行政訴訟。具體復(fu)(fu)議請(qing)(qing)(qing)求和訴訟請(qing)(qing)(qing)求可表(biao)述為:“請(qing)(qing)(qing)求履行補償(chang)安置(zhi)法(fa)定職責”。

五(wu)是,土(tu)地行政主(zhu)管部門作(zuo)出(chu)(chu)責令交出(chu)(chu)土(tu)地決(jue)定并申請法院強制(zhi)執行(強制(zhi)搬離),地上有房屋和附著物同時予以強制(zhi)拆除。

(三)市、縣人民(min)政府的(de)征地公告具有(you)可訴性,且應進行全面審查。

根(gen)據國(guo)發〔2015〕27號(hao)《國(guo)務院(yuan)(yuan)關(guan)于(yu)取消非行(xing)政(zheng)(zheng)許可(ke)審(shen)批(pi)(pi)事(shi)項(xiang)的(de)(de)(de)(de)(de)決定(ding)》,國(guo)務院(yuan)(yuan)與省(sheng)級(ji)人(ren)民(min)(min)(min)(min)政(zheng)(zheng)府(fu)(fu)征(zheng)(zheng)地(di)(di)(di)(di)(di)批(pi)(pi)復(fu)(fu)(fu)(fu),已經從(cong)原(yuan)來(lai)的(de)(de)(de)(de)(de)非行(xing)政(zheng)(zheng)許可(ke)審(shen)批(pi)(pi)事(shi)項(xiang),調(diao)整為(wei)屬(shu)于(yu)政(zheng)(zheng)府(fu)(fu)內(nei)(nei)部審(shen)批(pi)(pi)事(shi)項(xiang)。征(zheng)(zheng)地(di)(di)(di)(di)(di)批(pi)(pi)復(fu)(fu)(fu)(fu)與市(shi)、縣(xian)(xian)(xian)人(ren)民(min)(min)(min)(min)政(zheng)(zheng)府(fu)(fu)依據征(zheng)(zheng)地(di)(di)(di)(di)(di)批(pi)(pi)復(fu)(fu)(fu)(fu)實(shi)施(shi)具體征(zheng)(zheng)收(shou)(shou),屬(shu)于(yu)兩個不(bu)(bu)同的(de)(de)(de)(de)(de)概念。前(qian)者(zhe)具有(you)內(nei)(nei)部批(pi)(pi)準的(de)(de)(de)(de)(de)屬(shu)性(xing),后者(zhe)應(ying)屬(shu)代表國(guo)家實(shi)施(shi)征(zheng)(zheng)收(shou)(shou)行(xing)為(wei)。目前(qian),基于(yu)司法(fa)(fa)政(zheng)(zheng)策,省(sheng)級(ji)人(ren)民(min)(min)(min)(min)政(zheng)(zheng)府(fu)(fu)征(zheng)(zheng)地(di)(di)(di)(di)(di)批(pi)(pi)復(fu)(fu)(fu)(fu)仍然不(bu)(bu)可(ke)訴(su)(su)的(de)(de)(de)(de)(de)情況(kuang)下,如果繼續認為(wei)市(shi)、縣(xian)(xian)(xian)人(ren)民(min)(min)(min)(min)政(zheng)(zheng)府(fu)(fu)的(de)(de)(de)(de)(de)征(zheng)(zheng)地(di)(di)(di)(di)(di)公(gong)(gong)告行(xing)為(wei)(或(huo)者(zhe)說(shuo)征(zheng)(zheng)地(di)(di)(di)(di)(di)行(xing)為(wei))也(ye)不(bu)(bu)可(ke)訴(su)(su),就容(rong)易讓(rang)征(zheng)(zheng)地(di)(di)(di)(di)(di)行(xing)為(wei)規避司法(fa)(fa)審(shen)查,難(nan)以(yi)保(bao)證《中華人(ren)民(min)(min)(min)(min)共和國(guo)土(tu)地(di)(di)(di)(di)(di)管理(li)法(fa)(fa)》和中央政(zheng)(zheng)策的(de)(de)(de)(de)(de)順(shun)利(li)實(shi)施(shi)。因此,原(yuan)告對(dui)征(zheng)(zheng)地(di)(di)(di)(di)(di)行(xing)為(wei)不(bu)(bu)服的(de)(de)(de)(de)(de),應(ying)當以(yi)市(shi)、縣(xian)(xian)(xian)人(ren)民(min)(min)(min)(min)政(zheng)(zheng)府(fu)(fu)為(wei)被告,以(yi)征(zheng)(zheng)地(di)(di)(di)(di)(di)公(gong)(gong)告為(wei)作(zuo)為(wei)可(ke)訴(su)(su)行(xing)政(zheng)(zheng)行(xing)為(wei)提起訴(su)(su)訟。人(ren)民(min)(min)(min)(min)法(fa)(fa)院(yuan)(yuan)在審(shen)查市(shi)、縣(xian)(xian)(xian)人(ren)民(min)(min)(min)(min)政(zheng)(zheng)府(fu)(fu)作(zuo)出(chu)的(de)(de)(de)(de)(de)征(zheng)(zheng)地(di)(di)(di)(di)(di)公(gong)(gong)告時,不(bu)(bu)宜將(jiang)征(zheng)(zheng)收(shou)(shou)土(tu)地(di)(di)(di)(di)(di)公(gong)(gong)告認定(ding)為(wei)國(guo)務院(yuan)(yuan)或(huo)省(sheng)級(ji)人(ren)民(min)(min)(min)(min)政(zheng)(zheng)府(fu)(fu)征(zheng)(zheng)地(di)(di)(di)(di)(di)批(pi)(pi)復(fu)(fu)(fu)(fu)的(de)(de)(de)(de)(de)公(gong)(gong)告送達行(xing)為(wei),不(bu)(bu)能(neng)以(yi)征(zheng)(zheng)地(di)(di)(di)(di)(di)公(gong)(gong)告不(bu)(bu)創(chuang)設新的(de)(de)(de)(de)(de)權利(li)義務為(wei)由不(bu)(bu)予審(shen)查,或(huo)者(zhe)僅審(shen)查其是否符(fu)合(he)征(zheng)(zheng)地(di)(di)(di)(di)(di)批(pi)(pi)復(fu)(fu)(fu)(fu)的(de)(de)(de)(de)(de)內(nei)(nei)容(rong);而應(ying)當將(jiang)其獨(du)立的(de)(de)(de)(de)(de)征(zheng)(zheng)地(di)(di)(di)(di)(di)決定(ding),除審(shen)查與征(zheng)(zheng)地(di)(di)(di)(di)(di)批(pi)(pi)復(fu)(fu)(fu)(fu)內(nei)(nei)容(rong)是否一致(zhi)外(wai),還應(ying)對(dui)市(shi)縣(xian)(xian)(xian)人(ren)民(min)(min)(min)(min)政(zheng)(zheng)府(fu)(fu)上報國(guo)務院(yuan)(yuan)或(huo)省(sheng)級(ji)人(ren)民(min)(min)(min)(min)政(zheng)(zheng)府(fu)(fu)辦理(li)征(zheng)(zheng)地(di)(di)(di)(di)(di)批(pi)(pi)復(fu)(fu)(fu)(fu)的(de)(de)(de)(de)(de)相關(guan)申報材料的(de)(de)(de)(de)(de)合(he)法(fa)(fa)性(xing)全面進行(xing)審(shen)查。

人民(min)(min)法院要(yao)積極宣(xuan)傳引導(dao)地(di)(di)方(fang)政(zheng)府(fu)與(yu)土地(di)(di)行政(zheng)主管(guan)部門(men),通過制定(ding)地(di)(di)方(fang)性法規、規章、甚至(zhi)規范性文件(jian)的方(fang)式,引導(dao)市、縣人民(min)(min)政(zheng)府(fu)單獨(du)作出征地(di)(di)決(jue)定(ding),以取代征地(di)(di)公告,并(bing)引導(dao)原告直接(jie)起訴(su)征地(di)(di)決(jue)定(ding)。

(四)引導起訴人針對直接確(que)定(ding)補償安(an)置(zhi)內(nei)容(rong)的(de)補償決定(ding)(補償裁決、補償內(nei)容(rong)告知(zhi)書以(yi)及具有具體(ti)補償內(nei)容(rong)的(de)公告、告知(zhi)書等)提起行政訴訟

補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)安置(zhi)是被(bei)征(zheng)收人(ren)(ren)最(zui)為(wei)(wei)關(guan)心的(de)(de)(de)問題。由于《中(zhong)華人(ren)(ren)民(min)共和(he)國(guo)土(tu)地(di)管理法(fa)(fa)(fa)》等僅規(gui)定(ding)(ding)(ding)(ding)簽(qian)訂(ding)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)協議(yi)和(he)發(fa)放相(xiang)關(guan)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)費用(yong),未明確(que)(que)規(gui)定(ding)(ding)(ding)(ding)達不(bu)成(cheng)協議(yi)后的(de)(de)(de)處理方(fang)式,也(ye)無類似于《國(guo)有土(tu)地(di)上(shang)(shang)房(fang)屋征(zheng)收與補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)條例(li)》規(gui)定(ding)(ding)(ding)(ding)的(de)(de)(de)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)決(jue)(jue)(jue)定(ding)(ding)(ding)(ding)程序,因此造(zao)成(cheng)難以準(zhun)確(que)(que)確(que)(que)定(ding)(ding)(ding)(ding)訴(su)(su)(su)(su)訟(song)標(biao)的(de)(de)(de)與補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)內(nei)容(rong)(rong)。巡回區地(di)方(fang)性(xing)規(gui)定(ding)(ding)(ding)(ding)中(zhong),有關(guan)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)決(jue)(jue)(jue)定(ding)(ding)(ding)(ding)的(de)(de)(de)名(ming)稱(cheng)、內(nei)容(rong)(rong)、方(fang)式均不(bu)統一:有的(de)(de)(de)并不(bu)作(zuo)(zuo)出(chu)帶(dai)有補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)內(nei)容(rong)(rong)的(de)(de)(de)決(jue)(jue)(jue)定(ding)(ding)(ding)(ding),有的(de)(de)(de)在(zai)(zai)責令交出(chu)土(tu)地(di)決(jue)(jue)(jue)定(ding)(ding)(ding)(ding)書(shu)中(zhong)增加(jia)(jia)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)內(nei)容(rong)(rong),有的(de)(de)(de)僅以口頭(tou)方(fang)式告(gao)知(zhi)具(ju)體(ti)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)款項(xiang)和(he)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)內(nei)容(rong)(rong),有的(de)(de)(de)僅告(gao)知(zhi)按照補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)方(fang)案(an)執行(xing)(xing)卻(que)無具(ju)體(ti)金額(e)和(he)內(nei)容(rong)(rong)。被(bei)征(zheng)收人(ren)(ren)依法(fa)(fa)(fa)應(ying)當(dang)(dang)得到的(de)(de)(de)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)內(nei)容(rong)(rong)缺乏具(ju)體(ti)載體(ti),客觀上(shang)(shang)造(zao)成(cheng)部分當(dang)(dang)事(shi)人(ren)(ren)對(dui)征(zheng)地(di)程序和(he)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)程序的(de)(de)(de)所有行(xing)(xing)政(zheng)(zheng)行(xing)(xing)為(wei)(wei)反復訴(su)(su)(su)(su)訟(song),既加(jia)(jia)重(zhong)行(xing)(xing)政(zheng)(zheng)機(ji)關(guan)和(he)人(ren)(ren)民(min)法(fa)(fa)(fa)院(yuan)(yuan)負擔,也(ye)易引(yin)發(fa)重(zhong)復訴(su)(su)(su)(su)訟(song)和(he)濫(lan)訴(su)(su)(su)(su),還導(dao)致補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)糾(jiu)(jiu)紛(fen)久(jiu)拖不(bu)決(jue)(jue)(jue)和(he)循環訴(su)(su)(su)(su)訟(song)。人(ren)(ren)民(min)法(fa)(fa)(fa)院(yuan)(yuan)應(ying)當(dang)(dang)引(yin)導(dao)地(di)方(fang)政(zheng)(zheng)府及(ji)其(qi)土(tu)地(di)行(xing)(xing)政(zheng)(zheng)主管部門在(zai)(zai)無法(fa)(fa)(fa)通過簽(qian)訂(ding)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)安置(zhi)協議(yi)解決(jue)(jue)(jue)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)安置(zhi)糾(jiu)(jiu)紛(fen)的(de)(de)(de)情況下,要及(ji)時(shi)(shi)、積極、依法(fa)(fa)(fa)作(zuo)(zuo)出(chu)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)決(jue)(jue)(jue)定(ding)(ding)(ding)(ding)(補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)裁決(jue)(jue)(jue)、補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)內(nei)容(rong)(rong)告(gao)知(zhi)書(shu)、補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)事(shi)項(xiang)通知(zhi)書(shu)等),被(bei)征(zheng)收人(ren)(ren)對(dui)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)安置(zhi)不(bu)服的(de)(de)(de),應(ying)當(dang)(dang)對(dui)直(zhi)接(jie)確(que)(que)定(ding)(ding)(ding)(ding)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)安置(zhi)內(nei)容(rong)(rong)的(de)(de)(de)決(jue)(jue)(jue)定(ding)(ding)(ding)(ding)提起行(xing)(xing)政(zheng)(zheng)訴(su)(su)(su)(su)訟(song)。人(ren)(ren)民(min)法(fa)(fa)(fa)院(yuan)(yuan)在(zai)(zai)確(que)(que)定(ding)(ding)(ding)(ding)審(shen)(shen)查(cha)標(biao)的(de)(de)(de)時(shi)(shi),應(ying)當(dang)(dang)堅持一次性(xing)實質化解糾(jiu)(jiu)紛(fen),不(bu)應(ying)拘泥于補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)決(jue)(jue)(jue)定(ding)(ding)(ding)(ding)的(de)(de)(de)具(ju)體(ti)名(ming)稱(cheng),避免人(ren)(ren)為(wei)(wei)分立(li)為(wei)(wei)多個(ge)行(xing)(xing)政(zheng)(zheng)案(an)件(jian);存(cun)在(zai)(zai)多個(ge)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)性(xing)質的(de)(de)(de)行(xing)(xing)為(wei)(wei)時(shi)(shi),在(zai)(zai)一審(shen)(shen)庭審(shen)(shen)結束前,要引(yin)導(dao)當(dang)(dang)事(shi)人(ren)(ren)對(dui)最(zui)終確(que)(que)定(ding)(ding)(ding)(ding)了具(ju)體(ti)的(de)(de)(de)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)項(xiang)目、補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)內(nei)容(rong)(rong)的(de)(de)(de)行(xing)(xing)為(wei)(wei)起訴(su)(su)(su)(su),并合理確(que)(que)定(ding)(ding)(ding)(ding)爭議(yi)焦點(dian)。人(ren)(ren)民(min)法(fa)(fa)(fa)院(yuan)(yuan)在(zai)(zai)審(shen)(shen)查(cha)最(zui)終的(de)(de)(de)補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)行(xing)(xing)為(wei)(wei)時(shi)(shi),對(dui)前續的(de)(de)(de)與補(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)(chang)有關(guan)的(de)(de)(de)決(jue)(jue)(jue)定(ding)(ding)(ding)(ding)、認定(ding)(ding)(ding)(ding)等行(xing)(xing)政(zheng)(zheng)行(xing)(xing)為(wei)(wei)合法(fa)(fa)(fa)性(xing),應(ying)當(dang)(dang)一并進行(xing)(xing)審(shen)(shen)查(cha)。

理(li)論上(shang)來說,征地(di)主(zhu)(zhu)體(ti)與(yu)補償(chang)(chang)(chang)主(zhu)(zhu)體(ti)應(ying)當同一,但由于(yu)《中華人(ren)民共和(he)國(guo)土(tu)地(di)管理(li)法(fa)》也未明(ming)確征地(di)補償(chang)(chang)(chang)的主(zhu)(zhu)體(ti)與(yu)形式,因而巡回區普遍存在市、縣人(ren)民政(zheng)府實施征收而由土(tu)地(di)行(xing)政(zheng)主(zhu)(zhu)管部(bu)門進行(xing)補償(chang)(chang)(chang)的情況,人(ren)民法(fa)院(yuan)一般(ban)不宜否定土(tu)地(di)行(xing)政(zheng)主(zhu)(zhu)管部(bu)門或者“兩公(gong)告”中確定的其他補償(chang)(chang)(chang)主(zhu)(zhu)體(ti)作出補償(chang)(chang)(chang)決定的職權。

地方政(zheng)府(fu)或其(qi)土地行政(zheng)主管部門既未(wei)簽(qian)訂補(bu)償(chang)安置協議也未(wei)作(zuo)出(chu)補(bu)償(chang)性質決定的(de),當事人對(dui)補(bu)償(chang)安置不服(fu)引發糾紛的(de),可(ke)以考慮(lv)統一確定案由為“請求履行補(bu)償(chang)安置法(fa)定職責”,以市(shi)、縣人民政(zheng)府(fu)或其(qi)在“兩公告(gao)”中確定的(de)土地行政(zheng)主管等(deng)部門為被告(gao)。

(五)對征地補償安置方(fang)案公告、補償標準、土地調(diao)查(cha)登記行(xing)(xing)為(wei)等不服,原則(ze)上應(ying)當在對補償決定的審查(cha)中一并進(jin)行(xing)(xing)

市、縣人(ren)(ren)民政府已(yi)經(jing)作出(chu)補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)決定(ding)(ding)(ding)(ding)的(de)(de)(de),起(qi)訴(su)(su)(su)人(ren)(ren)針對征地補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)安(an)置方(fang)(fang)(fang)案(an)公告、補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)標準(zhun)、土地調查登(deng)記(ji)(ji)等提起(qi)行(xing)(xing)(xing)(xing)(xing)(xing)政訴(su)(su)(su)訟(song)的(de)(de)(de),人(ren)(ren)民法(fa)院(yuan)(yuan)應當釋明告知(zhi)起(qi)訴(su)(su)(su)人(ren)(ren)直接對補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)決定(ding)(ding)(ding)(ding)提起(qi)訴(su)(su)(su)訟(song);人(ren)(ren)民法(fa)院(yuan)(yuan)在審(shen)查補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)決定(ding)(ding)(ding)(ding)合(he)法(fa)性(xing)時,對起(qi)訴(su)(su)(su)人(ren)(ren)相關訴(su)(su)(su)訟(song)請求合(he)法(fa)性(xing)一(yi)并進行(xing)(xing)(xing)(xing)(xing)(xing)審(shen)查。當事人(ren)(ren)起(qi)訴(su)(su)(su)時,既(ji)無(wu)補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)安(an)置協議,也無(wu)補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)決定(ding)(ding)(ding)(ding)的(de)(de)(de),人(ren)(ren)民法(fa)院(yuan)(yuan)可(ke)以在一(yi)審(shen)庭(ting)審(shen)結(jie)束前,引導雙方(fang)(fang)(fang)進一(yi)步明確(que)(que)(que)爭議焦點和訴(su)(su)(su)訟(song)請求,可(ke)將案(an)由確(que)(que)(que)定(ding)(ding)(ding)(ding)為(wei)(wei)“請求履行(xing)(xing)(xing)(xing)(xing)(xing)補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)安(an)置法(fa)定(ding)(ding)(ding)(ding)職責”。人(ren)(ren)民法(fa)院(yuan)(yuan)審(shen)理(li)中對補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)安(an)置方(fang)(fang)(fang)案(an)、補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)標準(zhun)、登(deng)記(ji)(ji)確(que)(que)(que)認(ren)行(xing)(xing)(xing)(xing)(xing)(xing)為(wei)(wei)的(de)(de)(de)合(he)法(fa)性(xing)一(yi)并審(shen)查,原告主(zhu)張補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)方(fang)(fang)(fang)案(an)、補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)標準(zhun)、登(deng)記(ji)(ji)確(que)(que)(que)認(ren)行(xing)(xing)(xing)(xing)(xing)(xing)為(wei)(wei)不合(he)法(fa)理(li)由成立的(de)(de)(de),責令(ling)被(bei)告依法(fa)履行(xing)(xing)(xing)(xing)(xing)(xing)補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)安(an)置職責,能(neng)夠確(que)(que)(que)定(ding)(ding)(ding)(ding)具(ju)(ju)體(ti)補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)安(an)置方(fang)(fang)(fang)法(fa)或(huo)者具(ju)(ju)體(ti)補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)安(an)置內容的(de)(de)(de),人(ren)(ren)民法(fa)院(yuan)(yuan)可(ke)作出(chu)有具(ju)(ju)體(ti)內容的(de)(de)(de)履行(xing)(xing)(xing)(xing)(xing)(xing)判決。

起(qi)訴(su)(su)人(ren)堅持(chi)單獨起(qi)訴(su)(su)征(zheng)地補償安置(zhi)方(fang)案公(gong)告(gao)(gao)、補償標準(zhun)、登(deng)記確(que)認行(xing)為的,人(ren)民法(fa)院一(yi)般不予立案。市、縣人(ren)民政(zheng)府土地行(xing)政(zheng)主管(guan)部(bu)(bu)門(men)在(zai)征(zheng)收補償過程中(zhong),已經依法(fa)向被(bei)征(zheng)收農戶(hu)送達土地地類、面積(ji)和(he)地上附著物種(zhong)類、數量等(deng)的征(zheng)地調查(cha)(cha)結(jie)果的登(deng)記確(que)認行(xing)為,當事人(ren)未(wei)在(zai)法(fa)定期限內提(ti)出異議的,人(ren)民法(fa)院一(yi)般應支持(chi)征(zheng)地調查(cha)(cha)結(jie)果確(que)認行(xing)為。但是,土地行(xing)政(zheng)主管(guan)部(bu)(bu)門(men)在(zai)征(zheng)收補償過程中(zhong)未(wei)依法(fa)告(gao)(gao)知調查(cha)(cha)結(jie)果的,人(ren)民法(fa)院在(zai)其后的其他訴(su)(su)訟中(zhong),仍應當對(dui)調查(cha)(cha)結(jie)果確(que)認行(xing)為的合法(fa)性一(yi)并進(jin)行(xing)審查(cha)(cha)。

(六)補償標準、補償安(an)置(zhi)(zhi)方案是(shi)確定補償安(an)置(zhi)(zhi)內容的重要依據(ju),上一級人民政府(fu)受(shou)(shou)理(li)復(fu)議(yi)申(shen)請(qing)并(bing)作出行(xing)政復(fu)議(yi)決定后,復(fu)議(yi)申(shen)請(qing)人提(ti)起行(xing)政訴訟的,人民法院(yuan)應予(yu)受(shou)(shou)理(li)。

根據《中華人民(min)(min)共和國(guo)土地(di)管理(li)法實施條例》第25條第三(san)款(kuan)與《司法部關于(yu)依法做好征地(di)補償安(an)置(zhi)爭議行(xing)(xing)政(zheng)(zheng)(zheng)復議工作(zuo)的(de)通知》(國(guo)法[2011]35號)以(yi)(yi)(yi)及《最高人民(min)(min)法院(yuan)關于(yu)審理(li)涉及農(nong)村集體土地(di)行(xing)(xing)政(zheng)(zheng)(zheng)案件若干問題(ti)的(de)規(gui)定》第十(shi)條規(gui)定精(jing)神(shen),被(bei)征地(di)集體經(jing)濟(ji)組織和農(nong)民(min)(min)對市、縣人民(min)(min)政(zheng)(zheng)(zheng)府(fu)批準(zhun)的(de)征地(di)補償安(an)置(zhi)方(fang)案不(bu)服,應當先申請該市、縣人民(min)(min)政(zheng)(zheng)(zheng)府(fu)協(xie)調解決;協(xie)調不(bu)成的(de),向上一級人民(min)(min)政(zheng)(zheng)(zheng)府(fu)申請行(xing)(xing)政(zheng)(zheng)(zheng)復議;對行(xing)(xing)政(zheng)(zheng)(zheng)復議決定仍(reng)不(bu)服的(de),方(fang)可向人民(min)(min)法院(yuan)提(ti)起訴訟。人民(min)(min)法院(yuan)對補償標準(zhun)、補償安(an)置(zhi)方(fang)案是(shi)否符合法律(lv)、法規(gui)、規(gui)章以(yi)(yi)(yi)及省級人民(min)(min)政(zheng)(zheng)(zheng)府(fu)相關規(gui)定予以(yi)(yi)(yi)全面審查(cha)。

(七)起訴(su)不履行公告法(fa)定職責的,應當(dang)先向行政機關反映處理

根(gen)據《征(zheng)(zheng)(zheng)收(shou)(shou)土(tu)地(di)公(gong)告辦(ban)法(fa)(fa)(fa)》第(di)十四條(tiao)規(gui)定(ding),未依法(fa)(fa)(fa)進行(xing)征(zheng)(zheng)(zheng)收(shou)(shou)土(tu)地(di)公(gong)告、征(zheng)(zheng)(zheng)地(di)補償、安置方(fang)案公(gong)告的(de),被(bei)征(zheng)(zheng)(zheng)地(di)農(nong)村(cun)集(ji)體(ti)經(jing)濟組(zu)織、農(nong)村(cun)村(cun)民(min)(min)或(huo)者(zhe)(zhe)(zhe)其他權(quan)(quan)利人(ren)(ren)有權(quan)(quan)依法(fa)(fa)(fa)要求公(gong)告,有權(quan)(quan)拒絕辦(ban)理征(zheng)(zheng)(zheng)地(di)補償、安置手續。被(bei)征(zheng)(zheng)(zheng)地(di)農(nong)民(min)(min)認為(wei)(wei)市、縣人(ren)(ren)民(min)(min)政(zheng)(zheng)(zheng)(zheng)府(fu)或(huo)者(zhe)(zhe)(zhe)土(tu)地(di)行(xing)政(zheng)(zheng)(zheng)(zheng)主(zhu)管部(bu)門不(bu)(bu)(bu)履(lv)行(xing)公(gong)告等(deng)法(fa)(fa)(fa)定(ding)職責,經(jing)向行(xing)政(zheng)(zheng)(zheng)(zheng)機關申請、反映、投訴(su)后,有關行(xing)政(zheng)(zheng)(zheng)(zheng)機關不(bu)(bu)(bu)予處(chu)理而提起(qi)行(xing)政(zheng)(zheng)(zheng)(zheng)訴(su)訟的(de),人(ren)(ren)民(min)(min)法(fa)(fa)(fa)院應當受(shou)理。但起(qi)訴(su)人(ren)(ren)已經(jing)就征(zheng)(zheng)(zheng)地(di)行(xing)為(wei)(wei)、補償決(jue)定(ding)等(deng)提起(qi)訴(su)訟的(de),人(ren)(ren)民(min)(min)法(fa)(fa)(fa)院可以認為(wei)(wei)不(bu)(bu)(bu)具有訴(su)的(de)利益裁定(ding)不(bu)(bu)(bu)予立(li)案或(huo)者(zhe)(zhe)(zhe)駁回(hui)起(qi)訴(su)。起(qi)訴(su)上(shang)級人(ren)(ren)民(min)(min)政(zheng)(zheng)(zheng)(zheng)府(fu)或(huo)上(shang)級土(tu)地(di)行(xing)政(zheng)(zheng)(zheng)(zheng)主(zhu)管部(bu)門不(bu)(bu)(bu)履(lv)行(xing)層級監督職責的(de),人(ren)(ren)民(min)(min)法(fa)(fa)(fa)院裁定(ding)不(bu)(bu)(bu)予立(li)案或(huo)者(zhe)(zhe)(zhe)駁回(hui)起(qi)訴(su)。

(八(ba))責令交出土地行為屬于(yu)可訴(su)行政行為,且應以(yi)依(yi)法實施(shi)補償為前(qian)提條件

《中(zhong)華人(ren)民共(gong)和國土(tu)(tu)(tu)(tu)地(di)(di)(di)管(guan)理(li)(li)法(fa)(fa)(fa)》等法(fa)(fa)(fa)律法(fa)(fa)(fa)規(gui)對(dui)被(bei)征地(di)(di)(di)主(zhu)體如(ru)何收回(hui)土(tu)(tu)(tu)(tu)地(di)(di)(di)并強制(zhi)執行(xing),未作(zuo)出(chu)(chu)(chu)明確規(gui)定(ding)(ding)(ding)(ding)。《中(zhong)華人(ren)民共(gong)和國土(tu)(tu)(tu)(tu)地(di)(di)(di)管(guan)理(li)(li)法(fa)(fa)(fa)實(shi)施條(tiao)例》第四十五(wu)條(tiao)規(gui)定(ding)(ding)(ding)(ding),違反土(tu)(tu)(tu)(tu)地(di)(di)(di)管(guan)理(li)(li)法(fa)(fa)(fa)律、法(fa)(fa)(fa)規(gui)規(gui)定(ding)(ding)(ding)(ding),阻撓國家建設(she)征用土(tu)(tu)(tu)(tu)地(di)(di)(di)的(de),由縣級(ji)以上(shang)人(ren)民政(zheng)府(fu)(fu)土(tu)(tu)(tu)(tu)地(di)(di)(di)行(xing)政(zheng)主(zhu)管(guan)部(bu)門(men)責令(ling)交(jiao)出(chu)(chu)(chu)土(tu)(tu)(tu)(tu)地(di)(di)(di);拒不(bu)(bu)(bu)交(jiao)出(chu)(chu)(chu)土(tu)(tu)(tu)(tu)地(di)(di)(di)的(de),申請人(ren)民法(fa)(fa)(fa)院(yuan)強制(zhi)執行(xing)。因此,被(bei)征地(di)(di)(di)主(zhu)體對(dui)縣級(ji)以上(shang)人(ren)民政(zheng)府(fu)(fu)土(tu)(tu)(tu)(tu)地(di)(di)(di)行(xing)政(zheng)主(zhu)管(guan)部(bu)門(men)根據上(shang)述(shu)規(gui)定(ding)(ding)(ding)(ding)作(zuo)出(chu)(chu)(chu)的(de)責令(ling)交(jiao)出(chu)(chu)(chu)土(tu)(tu)(tu)(tu)地(di)(di)(di)決定(ding)(ding)(ding)(ding)行(xing)為不(bu)(bu)(bu)服提(ti)起行(xing)政(zheng)訴訟的(de),人(ren)民法(fa)(fa)(fa)院(yuan)應當(dang)受理(li)(li)。土(tu)(tu)(tu)(tu)地(di)(di)(di)行(xing)政(zheng)主(zhu)管(guan)部(bu)門(men)作(zuo)出(chu)(chu)(chu)的(de)責令(ling)交(jiao)出(chu)(chu)(chu)土(tu)(tu)(tu)(tu)地(di)(di)(di)決定(ding)(ding)(ding)(ding)包含(han)具(ju)體的(de)補(bu)償安置(zhi)內容的(de),人(ren)民法(fa)(fa)(fa)院(yuan)應當(dang)全面審查補(bu)償安置(zhi)是否合(he)法(fa)(fa)(fa)、責令(ling)交(jiao)出(chu)(chu)(chu)土(tu)(tu)(tu)(tu)地(di)(di)(di)是否符(fu)合(he)法(fa)(fa)(fa)定(ding)(ding)(ding)(ding)條(tiao)件。既未簽訂補(bu)償安置(zhi)協議,也未依(yi)法(fa)(fa)(fa)提(ti)存補(bu)償款,又未作(zuo)出(chu)(chu)(chu)補(bu)償決定(ding)(ding)(ding)(ding)且補(bu)償明顯不(bu)(bu)(bu)合(he)理(li)(li)的(de)情況下,土(tu)(tu)(tu)(tu)地(di)(di)(di)行(xing)政(zheng)主(zhu)管(guan)部(bu)門(men)作(zuo)出(chu)(chu)(chu)的(de)責令(ling)交(jiao)出(chu)(chu)(chu)土(tu)(tu)(tu)(tu)地(di)(di)(di)行(xing)為,人(ren)民法(fa)(fa)(fa)院(yuan)不(bu)(bu)(bu)予(yu)支持。

(九)責令交出(chu)土地(di)行為的(de)強(qiang)制執行,應當按照(zhao)非訴行政執行程序進行

被征(zheng)地(di)(di)(di)主體(ti)不(bu)(bu)交出(chu)(chu)土(tu)地(di)(di)(di)的(de)(de)(de)(de),土(tu)地(di)(di)(di)行(xing)(xing)政(zheng)主管部門原則上(shang)(shang)應當(dang)按(an)照(zhao)《行(xing)(xing)政(zheng)強制法(fa)(fa)(fa)》《最高人民(min)(min)(min)(min)法(fa)(fa)(fa)院(yuan)關于審理(li)(li)(li)涉及農村(cun)集(ji)體(ti)土(tu)地(di)(di)(di)行(xing)(xing)政(zheng)案件(jian)(jian)若干問題的(de)(de)(de)(de)規定(ding)》等規定(ding),申(shen)請(qing)人民(min)(min)(min)(min)法(fa)(fa)(fa)院(yuan)強制執(zhi)行(xing)(xing),經人民(min)(min)(min)(min)法(fa)(fa)(fa)院(yuan)裁(cai)定(ding)準(zhun)予執(zhi)行(xing)(xing)的(de)(de)(de)(de),一(yi)般按(an)照(zhao)“裁(cai)執(zhi)分離”的(de)(de)(de)(de)要求,由(you)政(zheng)府組織實(shi)施同時,縣級以上(shang)(shang)人民(min)(min)(min)(min)政(zheng)府土(tu)地(di)(di)(di)行(xing)(xing)政(zheng)主管部門申(shen)請(qing)人民(min)(min)(min)(min)法(fa)(fa)(fa)院(yuan)執(zhi)行(xing)(xing)其作(zuo)出(chu)(chu)的(de)(de)(de)(de)責令交出(chu)(chu)土(tu)地(di)(di)(di)決定(ding)的(de)(de)(de)(de),還應當(dang)符合(he)(he)下列(lie)條件(jian)(jian):①征(zheng)收(shou)土(tu)地(di)(di)(di)方案已經有權(quan)(quan)機關依法(fa)(fa)(fa)批準(zhun);②市(shi)、縣人民(min)(min)(min)(min)政(zheng)府和土(tu)地(di)(di)(di)管理(li)(li)(li)部門已經依照(zhao)土(tu)地(di)(di)(di)管理(li)(li)(li)法(fa)(fa)(fa)和土(tu)地(di)(di)(di)管理(li)(li)(li)法(fa)(fa)(fa)實(shi)施條例(li)規定(ding)的(de)(de)(de)(de)程序實(shi)施征(zheng)地(di)(di)(di)行(xing)(xing)為;③被征(zheng)收(shou)土(tu)地(di)(di)(di)所(suo)有權(quan)(quan)人、使用人已經依法(fa)(fa)(fa)得到安置(zhi)補(bu)償或(huo)者(zhe)無(wu)正當(dang)理(li)(li)(li)由(you)拒絕接(jie)受安置(zhi)補(bu)償,且(qie)拒不(bu)(bu)交出(chu)(chu)土(tu)地(di)(di)(di),已經影響到征(zheng)收(shou)工(gong)作(zuo)的(de)(de)(de)(de)正常進行(xing)(xing);④符合(he)(he)《最高人民(min)(min)(min)(min)法(fa)(fa)(fa)院(yuan)關于適用〈中(zhong)華人民(min)(min)(min)(min)共(gong)和國行(xing)(xing)政(zheng)訴(su)訟法(fa)(fa)(fa)〉的(de)(de)(de)(de)解釋》第(di)一(yi)百五(wu)(wu)(wu)十五(wu)(wu)(wu)條第(di)一(yi)款規定(ding)的(de)(de)(de)(de)條件(jian)(jian)。同時,根據該條第(di)三(san)款規定(ding),人民(min)(min)(min)(min)法(fa)(fa)(fa)院(yuan)對(dui)符合(he)(he)條件(jian)(jian)的(de)(de)(de)(de)申(shen)請(qing),應當(dang)在五(wu)(wu)(wu)日內立案受理(li)(li)(li),并(bing)通知申(shen)請(qing)人;對(dui)不(bu)(bu)符合(he)(he)條件(jian)(jian)的(de)(de)(de)(de)申(shen)請(qing),應當(dang)裁(cai)定(ding)不(bu)(bu)予受理(li)(li)(li)。

(十)強(qiang)制(zhi)拆(chai)除(強(qiang)制(zhi)搬(ban)遷(qian))行(xing)(xing)為是否(fou)可訴(su),取(qu)決于其是否(fou)擴大人(ren)民法(fa)院準予執(zhi)(zhi)(zhi)行(xing)(xing)裁定的執(zhi)(zhi)(zhi)行(xing)(xing)范圍(wei)或(huo)者(zhe)違法(fa)采取(qu)執(zhi)(zhi)(zhi)行(xing)(xing)措施

根據《最高人民法(fa)(fa)院(yuan)關于“裁(cai)執分離”后行(xing)政機(ji)關組織實施(shi)行(xing)為(wei)是否具有可訴性(xing)問題(ti)的(de)批復(fu)》(〔2017〕最高法(fa)(fa)行(xing)他550號)精神,行(xing)政機(ji)關未(wei)作出補償決定或(huo)者然(ran)雖(sui)作出補償決定但(dan)未(wei)經法(fa)(fa)院(yuan)審查準予強制(zhi)(zhi)執行(xing)即實施(shi)強制(zhi)(zhi)搬遷(qian),被(bei)征收人對強制(zhi)(zhi)搬遷(qian)行(xing)為(wei)提(ti)起(qi)訴訟的(de),人民法(fa)(fa)院(yuan)應予受理(li)(li)。人民法(fa)(fa)院(yuan)已(yi)經裁(cai)定準予強制(zhi)(zhi)執行(xing)并交由市、縣人民政府土(tu)地(di)行(xing)政主(zhu)管(guan)部(bu)門強制(zhi)(zhi)執行(xing),而(er)被(bei)征收人起(qi)訴土(tu)地(di)行(xing)政主(zhu)管(guan)部(bu)門及(ji)其委托(tuo)的(de)主(zhu)體(ti)強制(zhi)(zhi)搬遷(qian)行(xing)為(wei)違法(fa)(fa)的(de),人民法(fa)(fa)院(yuan)一般(ban)不予受理(li)(li);但(dan)被(bei)征收人能夠(gou)提(ti)供(gong)初步證(zheng)據證(zheng)明(ming)實施(shi)強制(zhi)(zhi)搬遷(qian)擴大執行(xing)范圍或(huo)者違法(fa)(fa)采取(qu)措(cuo)施(shi)的(de)除(chu)外(wai)。

五、如何確定原告主(zhu)體資格,如何保護不同權(quan)利(li)主(zhu)體的不同權(quan)利(li)?

征收農(nong)村集體(ti)土(tu)地(di)(di)涉及(ji)(ji)多重(zhong)權利(li)(li)和(he)不同主(zhu)體(ti),包括集體(ti)土(tu)地(di)(di)所(suo)有權人(ren)、集體(ti)經(jing)(jing)(jing)濟組織(zhi)成員宅基地(di)(di)使用權和(he)土(tu)地(di)(di)承(cheng)包經(jing)(jing)(jing)營權、實際(ji)經(jing)(jing)(jing)營者經(jing)(jing)(jing)營權、地(di)(di)上(shang)附(fu)著物及(ji)(ji)青苗所(suo)有權、集體(ti)建(jian)設用地(di)(di)使用權等(deng)。人(ren)民法院要(yao)按照(zhao)訴訟請(qing)(qing)求和(he)請(qing)(qing)求人(ren)民法院保障的(de)權利(li)(li)類別,科學確(que)定征收補償案(an)件(jian)的(de)原告。

(一(yi))起(qi)訴(su)征地行為(wei)的(列(lie)表序(xu)號(hao)錯(cuo)誤、列(lie)表序(xu)號(hao)丟失、列(lie)表序(xu)號(hao)多余(yu))

1. 對征(zheng)地(di)公(gong)告(征(zheng)地(di)批(pi)復、征(zheng)收決定)等直接影響所有(you)權的行(xing)(xing)為(wei)不(bu)(bu)服(fu)的,農(nong)村(cun)(cun)集體(ti)(ti)土(tu)地(di)所有(you)權人即村(cun)(cun)民委(wei)員會或者(zhe)(zhe)相(xiang)應農(nong)村(cun)(cun)集體(ti)(ti)經濟(ji)(ji)組(zu)織可以作為(wei)原告提起(qi)(qi)行(xing)(xing)政(zheng)訴訟;村(cun)(cun)民委(wei)員會或者(zhe)(zhe)農(nong)村(cun)(cun)集體(ti)(ti)經濟(ji)(ji)組(zu)織對涉及農(nong)村(cun)(cun)集體(ti)(ti)土(tu)地(di)的行(xing)(xing)政(zheng)行(xing)(xing)為(wei)不(bu)(bu)起(qi)(qi)訴的,過半數(shu)的村(cun)(cun)民可以以集體(ti)(ti)經濟(ji)(ji)組(zu)織名義提起(qi)(qi)行(xing)(xing)政(zheng)訴訟。


2. 農村集體經(jing)濟組織成員雖(sui)然轉(zhuan)為(wei)(wei)城鎮居(ju)民,但對涉及農村集體土地的行(xing)(xing)政行(xing)(xing)為(wei)(wei)不服的,過半(ban)數的原集體經(jing)濟組織成員可(ke)以提起行(xing)(xing)政訴訟(song)。


3. 被征地(di)農戶(hu)起訴征地(di)行為的,人民法(fa)院重點審(shen)查征收其(qi)實(shi)際承(cheng)包經營(ying)的土地(di)和實(shi)際使用的宅(zhai)基(ji)地(di)是否合(he)法(fa)。


(二(er))起訴具(ju)體補償(chang)安置行為的

1. 被征地(di)農戶基(ji)于所承包的(de)土地(di)、附(fu)著物與青苗、宅(zhai)基(ji)地(di)及(ji)房屋以及(ji)社(she)會保(bao)障等權(quan)益,對補償(chang)(chang)安置行為不服的(de),可以就補償(chang)(chang)問題以自己的(de)名義提起行政訴訟。


2. 村集體經濟組織成員以(yi)外的(de)農村土地(di)(di)經營權人、土地(di)(di)承租人、集體建設用(yong)地(di)(di)使用(yong)權人以(yi)及土地(di)(di)經營權人等,與補償安置行為之間有(you)利害關(guan)系,可以(yi)就補償問題以(yi)自己的(de)名義提(ti)起行政訴訟。


3. 房屋所(suo)有(you)(you)權(quan)(quan)人(ren)(ren)、土地(di)(di)所(suo)有(you)(you)權(quan)(quan)人(ren)(ren)已經就(jiu)相(xiang)應補(bu)償(chang)安(an)置(zhi)問題簽訂補(bu)償(chang)安(an)置(zhi)協(xie)議并(bing)實際履行的,其他土地(di)(di)實際使用(yong)人(ren)(ren)對(dui)補(bu)償(chang)安(an)置(zhi)對(dui)象(xiang)產生異議的,宜通(tong)過(guo)第三人(ren)(ren)撤銷之(zhi)訴(su)的方式通(tong)過(guo)民事途徑解決;但確有(you)(you)證據證明(ming)補(bu)償(chang)安(an)置(zhi)協(xie)議是無(wu)權(quan)(quan)處分(fen)的,權(quan)(quan)利人(ren)(ren)也(ye)可作為原告請求履行補(bu)償(chang)安(an)置(zhi)法定職責。


(三(san))起訴(su)其(qi)他行(xing)政(zheng)行(xing)為的

1. 被(bei)征地農戶(hu)因對補償安置行(xing)為(wei)不服,延伸起訴與(yu)其(qi)無直接法律上利(li)害關系的規(gui)劃部(bu)門(men)(men)選址意見、發展改革部(bu)門(men)(men)立項審批行(xing)為(wei)、環境保(bao)護(hu)部(bu)門(men)(men)環境影響評(ping)價等行(xing)為(wei)的,一般不具備原告主體(ti)資格(ge)。


2. 征地(di)補(bu)償活動結束后,被(bei)征地(di)農民起訴(su)土地(di)行政主(zhu)管部門出讓國有土地(di)使(shi)用(yong)權(quan)以及辦(ban)理相應不動產權(quan)證書(shu)等行為(wei)的,一(yi)般(ban)不具有原告主(zhu)體資格。


(四)對濫用(yong)訴訟權利的(de)處(chu)理

人(ren)(ren)民(min)(min)法(fa)院(yuan)應(ying)當(dang)(dang)(dang)引導當(dang)(dang)(dang)事(shi)人(ren)(ren)誠信理(li)性訴(su)(su)訟(song)(song),加大(da)對(dui)惡意(yi)訴(su)(su)訟(song)(song)、濫(lan)用訴(su)(su)訟(song)(song)權利等非誠信訴(su)(su)訟(song)(song)行(xing)(xing)為(wei)的(de)(de)打擊力度,充分(fen)發揮(hui)訴(su)(su)訟(song)(song)費(fei)用、律師費(fei)用調(diao)節當(dang)(dang)(dang)事(shi)人(ren)(ren)訴(su)(su)訟(song)(song)行(xing)(xing)為(wei)的(de)(de)杠桿作用,促使當(dang)(dang)(dang)事(shi)人(ren)(ren)選擇適當(dang)(dang)(dang)方(fang)式解決糾(jiu)紛。當(dang)(dang)(dang)事(shi)人(ren)(ren)存在濫(lan)用訴(su)(su)訟(song)(song)權利等明(ming)顯不當(dang)(dang)(dang)行(xing)(xing)為(wei),造成訴(su)(su)訟(song)(song)對(dui)方(fang)或第三人(ren)(ren)直接損失的(de)(de),人(ren)(ren)民(min)(min)法(fa)院(yuan)可以(yi)根據《行(xing)(xing)政訴(su)(su)訟(song)(song)法(fa)》《民(min)(min)事(shi)訴(su)(su)訟(song)(song)法(fa)》以(yi)及《最高人(ren)(ren)民(min)(min)法(fa)院(yuan)關于進一步推進案件繁簡分(fen)流優化司法(fa)資源配置的(de)(de)若(ruo)干意(yi)見》(法(fa)發〔2016〕21號)等規定,結合(he)具體(ti)情況,對(dui)無過錯方(fang)依法(fa)提出的(de)(de)賠償(chang)合(he)理(li)的(de)(de)律師費(fei)用等正當(dang)(dang)(dang)要求予以(yi)支(zhi)持。

六、如何準確把握被告主體(ti)資格,怎樣(yang)依法區分地(di)方(fang)各級人民政府與土地(di)行政主管部門法定職責?

人(ren)民(min)法院應當(dang)按照“誰(shui)行為(wei)、誰(shui)被告(gao)”原(yuan)(yuan)則,準確(que)確(que)定(ding)征收補(bu)償案件(jian)被告(gao)。原(yuan)(yuan)告(gao)起訴被告(gao)不適格(ge)的(de),可以(yi)根據《中華人(ren)民(min)共和(he)國行政訴訟(song)法》第(di)(di)二十(shi)(shi)六條(tiao)以(yi)及(ji)《最高人(ren)民(min)法院關于適用〈中華人(ren)民(min)共和(he)國行政訴訟(song)法〉的(de)解釋》第(di)(di)十(shi)(shi)九條(tiao)、第(di)(di)二十(shi)(shi)條(tiao)、第(di)(di)二十(shi)(shi)一條(tiao)、第(di)(di)二十(shi)(shi)三(san)條(tiao)、第(di)(di)二十(shi)(shi)四條(tiao)、第(di)(di)二十(shi)(shi)五條(tiao)等規定(ding),依法告(gao)知原(yuan)(yuan)告(gao)變(bian)更(geng)或(huo)者追加被告(gao),原(yuan)(yuan)告(gao)拒(ju)絕變(bian)更(geng)或(huo)者追加被告(gao)的(de),人(ren)民(min)法院結合案件(jian)具體(ti)情況,可以(yi)裁定(ding)駁(bo)回起訴。

(一)以(yi)法定征收補償行政主體(ti)為被告的

1. 對市、縣人民政府(fu)收到征(zheng)地批(pi)復后的(de)具體組織實(shi)施征(zheng)地行(xing)為(wei)和補償(chang)行(xing)為(wei)不服(fu)的(de),市、縣人民政府(fu)為(wei)被告。


2. 對市(shi)、縣土(tu)地(di)(di)行(xing)(xing)政(zheng)主(zhu)管(guan)部門(men)征地(di)(di)期間的(de)征地(di)(di)補償登記行(xing)(xing)為(wei)(wei)、調(diao)查確(que)認行(xing)(xing)為(wei)(wei)、不(bu)(bu)依(yi)法(fa)履行(xing)(xing)職責行(xing)(xing)為(wei)(wei)等不(bu)(bu)服(fu)的(de),市(shi)、縣土(tu)地(di)(di)行(xing)(xing)政(zheng)主(zhu)管(guan)部門(men)為(wei)(wei)被告。地(di)(di)方性法(fa)規(gui)、規(gui)章等對具體(ti)組織調(diao)查確(que)認行(xing)(xing)為(wei)(wei)的(de)行(xing)(xing)政(zheng)主(zhu)體(ti)有特(te)別(bie)規(gui)定的(de),從其規(gui)定。


3. 被(bei)征收人(ren)對強制(zhi)實(shi)施行(xing)(xing)(xing)(xing)為(wei)不服提起訴訟的(de)(de)(de),應(ying)當首先推定是具有法(fa)定責(ze)令(ling)交(jiao)出土(tu)(tu)地的(de)(de)(de)市、縣(xian)土(tu)(tu)地行(xing)(xing)(xing)(xing)政(zheng)(zheng)主(zhu)(zhu)管(guan)部門(men)(men)(men)(men)實(shi)施,宜以市、縣(xian)土(tu)(tu)地行(xing)(xing)(xing)(xing)政(zheng)(zheng)主(zhu)(zhu)管(guan)部門(men)(men)(men)(men)為(wei)被(bei)告(gao);市、縣(xian)土(tu)(tu)地行(xing)(xing)(xing)(xing)政(zheng)(zheng)主(zhu)(zhu)管(guan)部門(men)(men)(men)(men)認(ren)為(wei)自己未實(shi)施強制(zhi)行(xing)(xing)(xing)(xing)為(wei)的(de)(de)(de),應(ying)當向(xiang)人(ren)民(min)法(fa)院(yuan)舉證證明(ming)實(shi)際實(shi)施的(de)(de)(de)主(zhu)(zhu)體;當地政(zheng)(zheng)策性文件明(ming)確規定由鄉鎮人(ren)民(min)政(zheng)(zheng)府等(deng)組織強制(zhi)拆除的(de)(de)(de),應(ying)當視為(wei)市、縣(xian)土(tu)(tu)地行(xing)(xing)(xing)(xing)政(zheng)(zheng)主(zhu)(zhu)管(guan)部門(men)(men)(men)(men)委托。


4. 補(bu)(bu)償(chang)(chang)(chang)安(an)(an)置(zhi)(zhi)(zhi)(zhi)問題既未(wei)通(tong)過(guo)協商解決(jue),也(ye)無(wu)法(fa)定(ding)(ding)主體作出補(bu)(bu)償(chang)(chang)(chang)決(jue)定(ding)(ding),又無(wu)生效裁(cai)判(pan)對補(bu)(bu)償(chang)(chang)(chang)安(an)(an)置(zhi)(zhi)(zhi)(zhi)問題進行(xing)(xing)(xing)裁(cai)判(pan)的,合法(fa)房屋的被征(zheng)(zheng)收(shou)人應依(yi)法(fa)先行(xing)(xing)(xing)申請市、縣人民(min)政府或其(qi)指定(ding)(ding)的土(tu)地行(xing)(xing)(xing)政主管(guan)部(bu)門依(yi)法(fa)履(lv)行(xing)(xing)(xing)補(bu)(bu)償(chang)(chang)(chang)安(an)(an)置(zhi)(zhi)(zhi)(zhi)職(zhi)責,要求(qiu)依(yi)法(fa)作出包(bao)含補(bu)(bu)償(chang)(chang)(chang)安(an)(an)置(zhi)(zhi)(zhi)(zhi)內容的補(bu)(bu)償(chang)(chang)(chang)安(an)(an)置(zhi)(zhi)(zhi)(zhi)等決(jue)定(ding)(ding);市、縣人民(min)政府或其(qi)指定(ding)(ding)的土(tu)地行(xing)(xing)(xing)政主管(guan)部(bu)門在合理期限(xian)內拒絕作出補(bu)(bu)償(chang)(chang)(chang)安(an)(an)置(zhi)(zhi)(zhi)(zhi)決(jue)定(ding)(ding)的,被征(zheng)(zheng)收(shou)人可以起訴要求(qiu)依(yi)法(fa)履(lv)行(xing)(xing)(xing)補(bu)(bu)償(chang)(chang)(chang)安(an)(an)置(zhi)(zhi)(zhi)(zhi)法(fa)定(ding)(ding)職(zhi)責。


(二)以法律法規(gui)規(gui)章授權的組織、組建(jian)或者委托的行政主體(ti)為被告(gao)的

1. 對鄉鎮人民政(zheng)府、村民委(wei)員會等按照(zhao)法律法規(gui)規(gui)章授(shou)權依法行使(shi)征收補償(chang)過程中相關行政(zheng)管(guan)理職責行為(wei)不服(fu)的,鄉鎮人民政(zheng)府、村民委(wei)員會等法律法規(gui)規(gui)章授(shou)權的組織為(wei)被告。


2. 對項目指揮(hui)部(bu)(bu)、土(tu)地儲(chu)備中心等實際參與實施單(dan)位的行(xing)政(zheng)行(xing)為(wei)(wei)不服,或者(zhe)(zhe)對鄉鎮人民(min)政(zheng)府等受委托實施的行(xing)政(zheng)行(xing)為(wei)(wei)不服的,應當以(yi)組建項目指揮(hui)部(bu)(bu)等機構的行(xing)政(zheng)機關或者(zhe)(zhe)委托的行(xing)政(zheng)機關為(wei)(wei)被告(gao)。但是,市(shi)、縣人民(min)政(zheng)府已明確由土(tu)地行(xing)政(zheng)主(zhu)管部(bu)(bu)門(men)具體(ti)負責征地補(bu)償等實際管理工作的,也可以(yi)以(yi)市(shi)、縣土(tu)地行(xing)政(zheng)主(zhu)管部(bu)(bu)門(men)為(wei)(wei)適(shi)格被告(gao)。


(三)行(xing)政協議訴訟的被告

1. 被(bei)征(zheng)收(shou)人與市、縣人民(min)政(zheng)(zheng)府土(tu)地行(xing)政(zheng)(zheng)主管(guan)部(bu)門(men)或(huo)者(zhe)征(zheng)收(shou)管(guan)理(li)部(bu)門(men)或(huo)者(zhe)上(shang)述部(bu)門(men)委托的(de)機構(gou)簽(qian)訂補(bu)償(chang)安置協(xie)議(yi)后,起訴要求履行(xing)補(bu)償(chang)協(xie)議(yi)、變更協(xie)議(yi)、解除協(xie)議(yi)、確認(ren)協(xie)議(yi)無(wu)效等,應(ying)以該市、縣人民(min)政(zheng)(zheng)府土(tu)地行(xing)政(zheng)(zheng)主管(guan)部(bu)門(men)或(huo)者(zhe)征(zheng)收(shou)管(guan)理(li)部(bu)門(men)為被(bei)告。


2. 被征收人(ren)與(yu)不(bu)具備(bei)行政(zheng)(zheng)主體資(zi)格的(de)指(zhi)揮部(bu)(bu)、項(xiang)目(mu)部(bu)(bu)等簽訂補償安(an)置協議的(de),一般(ban)以組建該機構的(de)行政(zheng)(zheng)機關(guan)為被告;市、縣(xian)人(ren)民政(zheng)(zheng)府(fu)已經明(ming)確依(yi)法由土地行政(zheng)(zheng)主管部(bu)(bu)門依(yi)法負責具體補償安(an)置工(gong)作的(de),也可以以市、縣(xian)土地行政(zheng)(zheng)主管部(bu)(bu)門為被告。


(四(si))對(dui)其(qi)他行政主體(ti)為被告的

對土地征收補(bu)償過程中其他行(xing)政機(ji)關以自己的名(ming)義作(zuo)出(chu)的行(xing)政行(xing)為(wei)不服的,該行(xing)政機(ji)關為(wei)被(bei)告(gao)。

(五)對(dui)多列被告、提出多項訴訟請求且(qie)級別管轄也(ye)不同的起訴的處理

被征(zheng)收人(ren)(ren)(ren)(ren)將街道辦(ban)(ban)事處(chu)、鄉(xiang)鎮人(ren)(ren)(ren)(ren)民(min)(min)政(zheng)(zheng)府、土地(di)行政(zheng)(zheng)主管部(bu)門(men)與市、縣人(ren)(ren)(ren)(ren)民(min)(min)政(zheng)(zheng)府列(lie)為(wei)共同被告向中(zhong)級人(ren)(ren)(ren)(ren)民(min)(min)法(fa)院起(qi)訴(su)(su)強(qiang)拆行為(wei),但(dan)未提(ti)供相應的(de)(de)證(zheng)據證(zheng)明市、縣人(ren)(ren)(ren)(ren)民(min)(min)政(zheng)(zheng)府實施(shi)強(qiang)拆,而街道辦(ban)(ban)事處(chu)、鄉(xiang)鎮人(ren)(ren)(ren)(ren)民(min)(min)政(zheng)(zheng)府、土地(di)行政(zheng)(zheng)主管部(bu)門(men)承認實施(shi)強(qiang)拆的(de)(de),人(ren)(ren)(ren)(ren)民(min)(min)法(fa)院經(jing)審查(cha)有證(zheng)據證(zheng)明確非市、縣人(ren)(ren)(ren)(ren)民(min)(min)政(zheng)(zheng)府組織實施(shi)強(qiang)拆的(de)(de),應當(dang)依法(fa)釋(shi)(shi)明向有管轄權的(de)(de)基層(ceng)(ceng)人(ren)(ren)(ren)(ren)民(min)(min)法(fa)院提(ti)起(qi)行政(zheng)(zheng)訴(su)(su)訟(song);經(jing)釋(shi)(shi)明后(hou)堅持(chi)起(qi)訴(su)(su)的(de)(de),裁(cai)定駁回對(dui)(dui)市、縣人(ren)(ren)(ren)(ren)民(min)(min)政(zheng)(zheng)府的(de)(de)起(qi)訴(su)(su),移送有管轄權的(de)(de)基層(ceng)(ceng)人(ren)(ren)(ren)(ren)民(min)(min)法(fa)院管轄。對(dui)(dui)明顯濫用訴(su)(su)權或者(zhe)為(wei)規(gui)避級別管轄權,經(jing)釋(shi)(shi)明后(hou)拒絕變更被告的(de)(de),可以依據《最高人(ren)(ren)(ren)(ren)民(min)(min)法(fa)院關于適(shi)用〈中(zhong)華人(ren)(ren)(ren)(ren)民(min)(min)共和(he)國行政(zheng)(zheng)訴(su)(su)訟(song)法(fa)〉的(de)(de)解釋(shi)(shi)》第五十五條第二款規(gui)定,退(tui)回訴(su)(su)狀并記錄在冊;堅持(chi)起(qi)訴(su)(su)的(de)(de),裁(cai)定不予立案。

(六(liu))對起訴要求履行監(jian)督查處(chu)法定職責的處(chu)理(li)

1. 被征地(di)農戶認為用地(di)單位存(cun)在未批(pi)先(xian)用、少批(pi)多用等違(wei)反土(tu)地(di)管(guan)理法律、法規(gui)情形且侵犯其合法權益(yi)的,應當向市(shi)、縣土(tu)地(di)行政(zheng)(zheng)主(zhu)管(guan)部(bu)門投(tou)訴(su)舉報,對投(tou)訴(su)舉報處理不服提起訴(su)訟(song)的,應當以具有(you)監督檢查職(zhi)權的市(shi)、縣土(tu)地(di)行政(zheng)(zheng)主(zhu)管(guan)部(bu)門為被告(gao),而(er)不應以省級、國家(jia)土(tu)地(di)行政(zheng)(zheng)主(zhu)管(guan)部(bu)門作為被告(gao)。


2. 被征(zheng)(zheng)地農戶(hu)已經(jing)對征(zheng)(zheng)地行(xing)為、補償行(xing)為等提(ti)(ti)起(qi)過(guo)訴(su)(su)訟(song)且(qie)未獲支持(chi)的(de),或者提(ti)(ti)出的(de)投訴(su)(su)舉報確(que)屬信(xin)訪(fang)性質,被征(zheng)(zheng)地農戶(hu)對行(xing)政機關按(an)信(xin)訪(fang)程序處理(li)的(de)行(xing)為不(bu)服提(ti)(ti)起(qi)訴(su)(su)訟(song)的(de),人民(min)法院不(bu)予立(li)案(an)。


七、如(ru)何準(zhun)確(que)把握起訴(su)期限,怎樣(yang)引導當事人在征(zheng)收補償(chang)行政程序中解決征(zheng)地糾紛?

人民法(fa)(fa)院(yuan)要重(zhong)視(shi)發揮裁判的規范引(yin)導功能,積(ji)極引(yin)導相(xiang)應的行政主(zhu)體在征(zheng)收補償安置環節(jie)及早發現(xian)并(bing)及時固定(ding)證據,在行政程(cheng)序中有效解決土(tu)地(di)地(di)類糾(jiu)紛、土(tu)地(di)面(mian)積(ji)糾(jiu)紛、附(fu)著物及青苗數量糾(jiu)紛,以及宅基地(di)與房屋類型(xing)、面(mian)積(ji)以及是(shi)否(fou)存在違法(fa)(fa)建設的糾(jiu)紛等。依法(fa)(fa)經過(guo)評(ping)估程(cheng)序的,要引(yin)導當事(shi)人窮盡(jin)評(ping)估異議(yi)程(cheng)序,減(jian)少(shao)因相(xiang)關證據被強制拆除滅失后,再訴(su)(su)請人民法(fa)(fa)院(yuan)審查(cha)問題。通過(guo)引(yin)導當事(shi)人正(zheng)確(que)認(ren)識并(bing)在恰當的起訴(su)(su)時機起訴(su)(su)相(xiang)應的行政行為(wei),既(ji)為(wei)保(bao)護(hu)被征(zheng)收人合法(fa)(fa)權益創(chuang)造條件,又盡(jin)快穩定(ding)征(zheng)收補償法(fa)(fa)律秩序,預防并(bing)減(jian)少(shao)涉訴(su)(su)信訪。

被征(zheng)(zheng)(zheng)收人(ren)對(dui)征(zheng)(zheng)(zheng)收補償等行(xing)為(wei)不(bu)服(fu)起(qi)(qi)訴(su)的(de),原則(ze)上應(ying)(ying)當(dang)根據《中(zhong)華人(ren)民(min)(min)(min)共和(he)(he)國行(xing)政(zheng)(zheng)訴(su)訟法》第四十六條(tiao)第一(yi)(yi)款(kuan)規定(ding),自知道(dao)(dao)或(huo)者(zhe)應(ying)(ying)當(dang)知道(dao)(dao)作(zuo)出行(xing)政(zheng)(zheng)行(xing)為(wei)之日(ri)起(qi)(qi)六個月內提起(qi)(qi)訴(su)訟。征(zheng)(zheng)(zheng)收補償等行(xing)為(wei)作(zuo)出時(shi)未告知公民(min)(min)(min)、法人(ren)或(huo)者(zhe)其他組織(zhi)訴(su)權或(huo)者(zhe)起(qi)(qi)訴(su)期(qi)(qi)限(xian)的(de),應(ying)(ying)當(dang)依據《最(zui)高人(ren)民(min)(min)(min)法院(yuan)關于適用(yong)〈中(zhong)華人(ren)民(min)(min)(min)共和(he)(he)國行(xing)政(zheng)(zheng)訴(su)訟法〉的(de)解釋》第六十四條(tiao)第一(yi)(yi)款(kuan)規定(ding),起(qi)(qi)訴(su)期(qi)(qi)限(xian)從公民(min)(min)(min)、法人(ren)或(huo)者(zhe)其他組織(zhi)知道(dao)(dao)或(huo)者(zhe)應(ying)(ying)當(dang)知道(dao)(dao)起(qi)(qi)訴(su)期(qi)(qi)限(xian)之日(ri)起(qi)(qi)計算,但從知道(dao)(dao)或(huo)者(zhe)應(ying)(ying)當(dang)知道(dao)(dao)行(xing)政(zheng)(zheng)行(xing)為(wei)內容之日(ri)起(qi)(qi)最(zui)長不(bu)得超過一(yi)(yi)年。對(dui)知道(dao)(dao)或(huo)者(zhe)應(ying)(ying)當(dang)知道(dao)(dao)征(zheng)(zheng)(zheng)收補償行(xing)為(wei)時(shi)間有分歧(qi)的(de),人(ren)民(min)(min)(min)法院(yuan)可以參照(zhao)原國務院(yuan)法制辦《關于認(ren)(ren)定(ding)被征(zheng)(zheng)(zheng)地農民(min)(min)(min)“知道(dao)(dao)”征(zheng)(zheng)(zheng)收土地決定(ding)有關問(wen)題(ti)的(de)意見(jian)》(國法〔2014〕40號)有關規定(ding)作(zuo)出認(ren)(ren)定(ding)。

人(ren)民法院(yuan)應(ying)當支(zhi)持并引導市、縣人(ren)民政(zheng)府和(he)土地(di)行政(zheng)主管部門,在征收土地(di)公告(gao)(gao)、征地(di)補償(chang)安置方案(an)公告(gao)(gao)等相關公告(gao)(gao)中,一次性統一告(gao)(gao)知對(dui)征地(di)補償(chang)安置中涉(she)及的行政(zheng)行為申(shen)請復議(yi)、提起行政(zheng)訴訟(song)的權利以及相應(ying)期限(xian),引導被征收人(ren)及時行使請求(qiu)救(jiu)濟的權利。

八(ba)、如何準(zhun)確把(ba)握(wo)不(bu)同類(lei)型案件的不(bu)同審查(cha)標準(zhun)和審查(cha)強度,依法規范土地征收補償安(an)置行為(wei)?

堅(jian)持(chi)對征地補償行為合法(fa)性全面審查原則,準(zhun)確把握實體審查與形式審查區(qu)別,按(an)照(zhao)不(bu)同(tong)種類(lei)行政行為合法(fa)性構成要(yao)件依法(fa)裁判。

(一)對征地行(xing)為合(he)法性審查(cha)

對市縣人民(min)政府征(zheng)地(di)公告(或(huo)省級人民(min)政府征(zheng)地(di)批復、征(zheng)地(di)決定)等征(zheng)收土地(di)行(xing)為,一般(ban)主要審查以下方(fang)面:

1. 是否符合(he)土地利用總體規劃;


2. 土地(di)權屬(shu)、地(di)類、面積、四至是否準確;


3. 占用農用地和未利(li)用地的(de),是否符(fu)合土地利(li)用年度計劃確定(ding)的(de)控制指標;占用耕(geng)地的(de),是否落實耕(geng)地占補平衡要求;


4. 是(shi)否已履行(xing)征地前(qian)的告知、確認(ren)和聽證程序;


5. 征收土地的(de)補償標準(zhun)和安(an)置(zhi)方式(shi)是(shi)否符(fu)合法(fa)(fa)律法(fa)(fa)規(gui)規(gui)定;


6. 是否(fou)屬于省(sheng)級人民政(zheng)府審(shen)批(pi)權限(xian)范圍;


7. 單獨選址的建設項(xiang)目(mu)用地(di)(di),是(shi)否(fou)符合產業政策(ce)和供(gong)地(di)(di)政策(ce),是(shi)否(fou)符合用地(di)(di)預審控制規(gui)模(mo),供(gong)地(di)(di)方(fang)式是(shi)否(fou)符合法律法規(gui)規(gui)定等。


(二)對補償(chang)安置行為的合法性(xing)審(shen)查

對于(yu)市(shi)、縣(xian)人民政府(fu)以及土地行(xing)政主管(guan)部(bu)門(men)作(zuo)出的具體的補償安置行(xing)為,一般主要審查以下方面:

1. 被征收土地(di)房屋是否在征地(di)批(pi)復批(pi)準或者征地(di)公告確定的(de)范圍內;


2. 土(tu)地補償(chang)費(fei)(fei)、安置(zhi)補助費(fei)(fei)、土(tu)地附著物和青(qing)苗補償(chang)費(fei)(fei)的支付標準、數額、對象和方式,是否(fou)符合(he)法律(lv)法規(gui)、省級(ji)人民政府規(gui)章等規(gui)定,是否(fou)符合(he)市、縣人民政府土(tu)地行政主(zhu)管(guan)部門征地統一年產值標準或者征地區(qu)片綜合(he)地價(jia)標準,相關(guan)標準是否(fou)及時進行調整;


3. ;本(ben)次征地所(suo)適用的(de),補償安置方案所(suo)確定(ding)的(de)標準是(shi)否符(fu)合(he)省級(ji)人民政(zheng)府(fu)的(de)要(yao)求,是(shi)否公(gong)平合(he)理,是(shi)否全面執行(xing)了省級(ji)人民政(zheng)府(fu)文件規定(ding);


4. 地(di)上(shang)附著物(wu)和青苗的數量(liang)、規格是(shi)否正確,補(bu)償標準、計算方式以(yi)及支(zhi)付方式是(shi)否適當。


5. 對(dui)被征(zheng)(zheng)收(shou)房屋的(de)面(mian)積(ji)(ji),一般以(yi)房屋權(quan)屬(shu)證書(shu)記(ji)(ji)載(zai)為(wei)準(zhun);未(wei)經(jing)(jing)(jing)登記(ji)(ji)但有批(pi)(pi)準(zhun)文(wen)(wen)(wen)件(jian)(jian)的(de),以(yi)批(pi)(pi)準(zhun)文(wen)(wen)(wen)件(jian)(jian)記(ji)(ji)載(zai)的(de)面(mian)積(ji)(ji),并結(jie)合實(shi)際測(ce)量情(qing)況(kuang)認定(ding);小于(yu)(yu)(yu)批(pi)(pi)準(zhun)面(mian)積(ji)(ji)的(de),按實(shi)際建筑面(mian)積(ji)(ji)計(ji)算(suan);大(da)于(yu)(yu)(yu)批(pi)(pi)準(zhun)面(mian)積(ji)(ji)的(de)按批(pi)(pi)準(zhun)文(wen)(wen)(wen)件(jian)(jian)計(ji)算(suan),超出部分可適當(dang)補償;未(wei)登記(ji)(ji)亦無批(pi)(pi)準(zhun)文(wen)(wen)(wen)件(jian)(jian)但根(gen)據(ju)(ju)(ju)當(dang)地(di)(di)政策系合法建筑的(de),應當(dang)尊重當(dang)地(di)(di)政策規定(ding);對(dui)被征(zheng)(zheng)收(shou)房屋的(de)用途,一般以(yi)房產(chan)證、土地(di)(di)使(shi)用權(quan)證登記(ji)(ji)的(de)用途為(wei)準(zhun);登記(ji)(ji)為(wei)住宅(zhai)而實(shi)際一直用于(yu)(yu)(yu)經(jing)(jing)(jing)營(ying),已經(jing)(jing)(jing)取得營(ying)業執照(zhao)并且提供納稅憑據(ju)(ju)(ju)的(de)房屋,可以(yi)根(gen)據(ju)(ju)(ju)《關于(yu)(yu)(yu)認真做好城鎮房屋拆(chai)遷工作維護社會穩定(ding)的(de)緊急(ji)通知》(國辦發〔2003〕42號)第四(si)條規定(ding),結(jie)合經(jing)(jing)(jing)營(ying)情(qing)況(kuang)、經(jing)(jing)(jing)營(ying)年(nian)限及納稅等實(shi)際情(qing)況(kuang),給予適當(dang)補償。


6. 以貨幣(bi)方(fang)式進行補償(chang)的(de),補償(chang)款能否(fou)保(bao)障被征收人(ren)的(de)基本居(ju)住權(quan),補償(chang)安(an)置的(de)確定方(fang)式是否(fou)公平合理。對征收時點與補償(chang)時點間隔期間過長(chang),補償(chang)超過合理期限,補償(chang)標準明顯偏(pian)低的(de),要依法予以調整。


7. 人民法(fa)(fa)院認為安置(zhi)補(bu)償(chang)遺漏法(fa)(fa)定補(bu)償(chang)項(xiang)目和(he)補(bu)償(chang)內容的,可以在裁判時(shi)直接增加(jia)相應補(bu)償(chang)內容,而無需(xu)責令重新作出新的補(bu)償(chang)決定,及時(shi)化(hua)解征遷(qian)糾紛,減(jian)少訟累;


8. 補(bu)償(chang)決定部(bu)(bu)分內容(rong)合(he)(he)法(fa)、部(bu)(bu)分內容(rong)不(bu)合(he)(he)法(fa)的,人民(min)法(fa)院可結(jie)合(he)(he)案件具體情況,作出部(bu)(bu)分撤銷判決,維(wei)持合(he)(he)法(fa)的補(bu)償(chang)內容(rong),并責(ze)令市(shi)、縣人民(min)政府支付或者提存合(he)(he)法(fa)的補(bu)償(chang)內容(rong),以避免當事人勝訴后,因不(bu)動產價格(ge)上(shang)漲產生新的損失(shi);


9. 征(zheng)(zheng)地決定(ding)(ding)作出(chu)前,市、縣人(ren)民政(zheng)府應當組織有(you)關部門對(dui)征(zheng)(zheng)收(shou)范圍內未(wei)經產權(quan)登記的建筑進行調查、認(ren)定(ding)(ding)和(he)(he)處(chu)理(li);未(wei)取得房(fang)(fang)(fang)屋所有(you)權(quan)證和(he)(he)土(tu)(tu)地使用(yong)證的,由法(fa)律規(gui)定(ding)(ding)的城鄉規(gui)劃主(zhu)管(guan)等(deng)部門進行或者根據當地政(zheng)策由多(duo)部門聯合(he)認(ren)定(ding)(ding),一般以批地建房(fang)(fang)(fang)審批表等(deng)批準建房(fang)(fang)(fang)材料確定(ding)(ding)的面積為(wei)依據;對(dui)于(yu)認(ren)定(ding)(ding)和(he)(he)處(chu)理(li)結果,被(bei)征(zheng)(zheng)收(shou)人(ren)可以申(shen)請行政(zheng)復議(yi)或提起(qi)行政(zheng)訴訟。對(dui)于(yu)經認(ren)定(ding)(ding)屬于(yu)違章建筑的,原則上不予補償(chang)或者賠償(chang),但對(dui)于(yu)無所有(you)權(quan)證房(fang)(fang)(fang)屋是否構成違章建筑的認(ren)定(ding)(ding),應結合(he)個案(an)具體情(qing)況,綜合(he)考慮(lv)土(tu)(tu)地歷史(shi)使用(yong)情(qing)況和(he)(he)現狀、是否符合(he)土(tu)(tu)地利用(yong)規(gui)劃以及有(you)關用(yong)地政(zheng)策、當地對(dui)類似房(fang)(fang)(fang)屋的補償(chang)政(zheng)策等(deng)因素,綜合(he)作出(chu)判斷(duan)。


10. 合(he)(he)理(li)補償(chang)安置宅基(ji)(ji)地(di)(di)上(shang)住(zhu)(zhu)房(fang),切實解決被拆(chai)(chai)遷(qian)(qian)(qian)農戶的(de)(de)(de)居住(zhu)(zhu)問題(ti)。征(zheng)地(di)(di)涉及拆(chai)(chai)遷(qian)(qian)(qian)農民宅基(ji)(ji)地(di)(di)住(zhu)(zhu)房(fang)的(de)(de)(de),應(ying)(ying)先(xian)安置后拆(chai)(chai)遷(qian)(qian)(qian),并(bing)做到(dao)被征(zheng)地(di)(di)農戶居住(zhu)(zhu)水平不降(jiang)低。宅基(ji)(ji)地(di)(di)上(shang)住(zhu)(zhu)房(fang)的(de)(de)(de)補償(chang)應(ying)(ying)因地(di)(di)制宜(yi)采(cai)取多元(yuan)化安置方(fang)(fang)式(shi)(shi),既可(ke)重新(xin)安排宅基(ji)(ji)地(di)(di)建房(fang),也可(ke)采(cai)取遷(qian)(qian)(qian)建安置方(fang)(fang)式(shi)(shi);既可(ke)以(yi)采(cai)取貨(huo)幣,也可(ke)以(yi)由被拆(chai)(chai)遷(qian)(qian)(qian)農戶自行(xing)選購房(fang)屋(wu)或(huo)選擇政府(fu)提供的(de)(de)(de)安置房(fang)。拆(chai)(chai)遷(qian)(qian)(qian)補償(chang)既要考慮(lv)(lv)被拆(chai)(chai)遷(qian)(qian)(qian)的(de)(de)(de)房(fang)屋(wu),還要考慮(lv)(lv)被征(zheng)收的(de)(de)(de)宅基(ji)(ji)地(di)(di)。城鄉結合(he)(he)部和城中(zhong)村被拆(chai)(chai)遷(qian)(qian)(qian)農戶合(he)(he)法(fa)房(fang)屋(wu)的(de)(de)(de)補償(chang),雖不宜(yi)按照鄰近國(guo)有土(tu)地(di)(di)上(shang)房(fang)屋(wu)的(de)(de)(de)市場交易價格作為評估基(ji)(ji)礎,但拆(chai)(chai)遷(qian)(qian)(qian)補償(chang)以(yi)及政府(fu)補貼等補償(chang)總(zong)和,應(ying)(ying)能保障其選購面積相當、位置適中(zhong)的(de)(de)(de)國(guo)有劃(hua)撥土(tu)地(di)(di)或(huo)者(zhe)國(guo)有出讓土(tu)地(di)(di)上(shang)建成的(de)(de)(de)房(fang)屋(wu)。


(三(san))對責令交地行為的(de)合(he)法性(xing)審查

對申請強制執行責(ze)令交出土地行為(wei),一(yi)般主要審查以(yi)下方面(mian):

1. 征地行為是否被依法批準(zhun);


2. 補(bu)償問題是否已(yi)經得到解決,包括是否已(yi)經簽署補(bu)償安置協議,或者市、縣人(ren)民政府是否已(yi)經作(zuo)出補(bu)償決定;


3. 是(shi)否落實先補償后搬遷,征收補償決定和(he)補償安置協議載(zai)明的補償內容是(shi)否如期支付或者提(ti)存;


4. 是否已(yi)經經過協(xie)商化解程序;


5. 對其后(hou)強(qiang)制搬遷行(xing)為(wei)的(de)審查(cha),重點(dian)在于是(shi)否(fou)嚴格(ge)遵守法(fa)定(ding)程(cheng)序,是(shi)否(fou)具有完備的(de)房屋內物(wu)品的(de)登(deng)記、運(yun)輸(shu)、保(bao)存和(he)交接等記錄。被征收人(ren)不(bu)配合搬遷的(de),是(shi)否(fou)以公證的(de)方式(shi)固定(ding)整(zheng)個搬遷過程(cheng)。


九、違法強制拆除案件如何確定被告、如何確定賠償金(jin)額?

(一)對存在未批先用、少批多(duo)用土地(di)情形的處理

審理因補(bu)(bu)償(chang)(chang)或者賠償(chang)(chang)引(yin)發(fa)的(de)(de)(de)征(zheng)(zheng)地(di)(di)案(an)件時(shi),市(shi)、縣人(ren)民(min)政(zheng)(zheng)府存(cun)在取(qu)得(de)省級人(ren)民(min)政(zheng)(zheng)府征(zheng)(zheng)地(di)(di)批(pi)復(fu)前,未批(pi)先用、少批(pi)多(duo)用實際(ji)占用原告(gao)土地(di)(di),原告(gao)要求(qiu)賠償(chang)(chang)相應(ying)損失的(de)(de)(de),人(ren)民(min)法院在確(que)定(ding)補(bu)(bu)償(chang)(chang)標準和補(bu)(bu)償(chang)(chang)金(jin)額時(shi),應(ying)當(dang)將補(bu)(bu)辦(ban)手續(xu)(xu)前的(de)(de)(de)賠償(chang)(chang)與(yu)補(bu)(bu)辦(ban)手續(xu)(xu)后(hou)的(de)(de)(de)補(bu)(bu)償(chang)(chang)相結合,適當(dang)增加賠償(chang)(chang)(補(bu)(bu)償(chang)(chang))金(jin)額,避(bi)免合法征(zheng)(zheng)地(di)(di)與(yu)違法征(zheng)(zheng)地(di)(di)農(nong)民(min)的(de)(de)(de)補(bu)(bu)償(chang)(chang)安置,懲戒未批(pi)先用、少批(pi)多(duo)用等(deng)違法行為,防(fang)止地(di)(di)方人(ren)民(min)政(zheng)(zheng)府違法零成本。

1. 人民(min)法(fa)院(yuan)一(yi)審(shen)判決前,市、縣人民(min)政(zheng)(zheng)府等已經補(bu)辦(ban)并(bing)(bing)取得國(guo)務院(yuan)或(huo)者省級人民(min)政(zheng)(zheng)府征(zheng)地(di)批(pi)復(fu)等手(shou)續(xu)的,應當確(que)認征(zheng)地(di)行(xing)(xing)為違(wei)法(fa),同時(shi)按征(zheng)地(di)批(pi)復(fu)作出(chu)時(shi)點(dian)的補(bu)償(chang)標準依(yi)法(fa)進行(xing)(xing)補(bu)償(chang)安置(zhi)(zhi);對補(bu)辦(ban)手(shou)續(xu)前的違(wei)法(fa)占地(di)行(xing)(xing)為,依(yi)法(fa)承(cheng)擔賠(pei)償(chang)責任,賠(pei)償(chang)因先(xian)行(xing)(xing)違(wei)法(fa)占地(di)給權利人造成的平均年產值損(sun)失、青苗損(sun)失、房屋租(zu)賃損(sun)失等直接損(sun)失。也可以結(jie)合行(xing)(xing)政(zheng)(zheng)管理和(he)審(shen)判工作實(shi)際(ji),統一(yi)按照行(xing)(xing)政(zheng)(zheng)賠(pei)償(chang)程序,在(zai)行(xing)(xing)政(zheng)(zheng)賠(pei)償(chang)案件中一(yi)并(bing)(bing)解決補(bu)償(chang)安置(zhi)(zhi)與賠(pei)償(chang)問題。


2. 人民(min)法(fa)(fa)(fa)院一(yi)(yi)審判決(jue)前(qian),市、縣人民(min)政(zheng)府等(deng)仍未(wei)依法(fa)(fa)(fa)取得(de)(de)上(shang)級機關征地(di)批(pi)復手(shou)續(xu)的,應當判決(jue)確(que)(que)認征地(di)行為(wei)違法(fa)(fa)(fa),并責(ze)令(ling)返還土地(di)并恢復原狀(zhuang)。對確(que)(que)因公共利(li)益需要無法(fa)(fa)(fa)恢復原狀(zhuang)的,依法(fa)(fa)(fa)判決(jue)承擔賠(pei)償(chang)(chang)(chang)責(ze)任。確(que)(que)定賠(pei)償(chang)(chang)(chang)標(biao)準(zhun)與賠(pei)償(chang)(chang)(chang)金(jin)額(e)時,既(ji)要賠(pei)償(chang)(chang)(chang)按一(yi)(yi)審判決(jue)時的補(bu)償(chang)(chang)(chang)安置(zhi)(zhi)標(biao)準(zhun)依法(fa)(fa)(fa)能(neng)夠得(de)(de)到的補(bu)償(chang)(chang)(chang)安置(zhi)(zhi),又要賠(pei)償(chang)(chang)(chang)按平均年(nian)產值與房屋年(nian)租賃費用為(wei)標(biao)準(zhun)的直(zhi)(zhi)接損失(shi),賠(pei)償(chang)(chang)(chang)金(jin)額(e)一(yi)(yi)直(zhi)(zhi)計算到依法(fa)(fa)(fa)取得(de)(de)征地(di)批(pi)復手(shou)續(xu)為(wei)止。


(二)對(dui)實施違(wei)法強拆行為行政主體的(de)認定

1. 經因(yin)依法(fa)批準的征地(di)過程中的強制拆除合(he)法(fa)房屋(wu)行為(wei)(wei)引(yin)發的行政(zheng)(zheng)案(an)件,原則上市、縣土(tu)(tu)地(di)行政(zheng)(zheng)主(zhu)管(guan)(guan)部門(men)(men)依法(fa)為(wei)(wei)推(tui)定的適格被告;除非有(you)相(xiang)反證據足以推(tui)翻上述推(tui)定。市、縣人民政(zheng)(zheng)府或(huo)土(tu)(tu)地(di)行政(zheng)(zheng)主(zhu)管(guan)(guan)部門(men)(men)可以通(tong)過政(zheng)(zheng)府文件、補(bu)償安置方(fang)案(an)等(deng),規定鄉(xiang)鎮(zhen)人民政(zheng)(zheng)府、基層群眾自(zi)治組織參(can)與強制拆除的,可以根(gen)據《最高人民法(fa)院關于適用〈中華人民共和國行政(zheng)(zheng)訴訟法(fa)〉的解(jie)釋(shi)》第二十條第三款的規定,視為(wei)(wei)土(tu)(tu)地(di)行政(zheng)(zheng)主(zhu)管(guan)(guan)部門(men)(men)的委(wei)托拆除。


2. 建設單(dan)位(wei)等民(min)事(shi)(shi)(shi)主(zhu)體擅自(zi)以自(zi)己名(ming)義違法(fa)(fa)實施強拆而(er)侵(qin)害物權的(de)(de),除(chu)承(cheng)擔民(min)事(shi)(shi)(shi)責(ze)(ze)任(ren)外,違反行(xing)政(zheng)管理規定(ding)的(de)(de),依法(fa)(fa)承(cheng)擔行(xing)政(zheng)責(ze)(ze)任(ren);構成犯(fan)罪的(de)(de),應(ying)當承(cheng)擔刑事(shi)(shi)(shi)責(ze)(ze)任(ren)。人民(min)法(fa)(fa)院認為行(xing)政(zheng)機關(guan)的(de)(de)主(zhu)管人員(yuan)、直接(jie)責(ze)(ze)任(ren)人員(yuan)有犯(fan)罪行(xing)為的(de)(de),應(ying)當根據《中華人民(min)共和國行(xing)政(zheng)訴訟法(fa)(fa)》第六十(shi)六條規定(ding),將有關(guan)材料移送公安、檢察機關(guan)。


(三)對實施違法強拆造成具(ju)體(ti)損(sun)失(shi)的(de)賠償

違法(fa)(fa)(fa)強(qiang)拆(chai)的(de)(de)(de)(de)(de)賠(pei)償(chang)(chang)(chang)應體(ti)現一(yi)定(ding)(ding)懲戒性,確(que)保被(bei)(bei)(bei)征(zheng)地(di)(di)農戶(hu)等(deng)(deng)得到的(de)(de)(de)(de)(de)賠(pei)償(chang)(chang)(chang)不(bu)低于(yu)其依(yi)照(zhao)(zhao)征(zheng)收補(bu)償(chang)(chang)(chang)安置方(fang)案(an)(an)等(deng)(deng)可(ke)以(yi)獲(huo)(huo)得的(de)(de)(de)(de)(de)征(zheng)地(di)(di)補(bu)償(chang)(chang)(chang)。人(ren)(ren)(ren)民法(fa)(fa)(fa)院(yuan)(yuan)在確(que)定(ding)(ding)賠(pei)償(chang)(chang)(chang)數(shu)額(e)時(shi),應當堅持全面(mian)賠(pei)償(chang)(chang)(chang)原(yuan)則,合理確(que)定(ding)(ding)房屋等(deng)(deng)的(de)(de)(de)(de)(de)評估時(shi)點(dian),并綜合協調適用《中(zhong)華人(ren)(ren)(ren)民共和國國家賠(pei)償(chang)(chang)(chang)法(fa)(fa)(fa)》規定(ding)(ding)的(de)(de)(de)(de)(de)賠(pei)償(chang)(chang)(chang)方(fang)式、賠(pei)償(chang)(chang)(chang)項目、賠(pei)償(chang)(chang)(chang)標準與土地(di)(di)管理法(fa)(fa)(fa)律法(fa)(fa)(fa)規等(deng)(deng)規定(ding)(ding)的(de)(de)(de)(de)(de)補(bu)償(chang)(chang)(chang)方(fang)式、補(bu)償(chang)(chang)(chang)項目、補(bu)償(chang)(chang)(chang)標準,確(que)保被(bei)(bei)(bei)征(zheng)收人(ren)(ren)(ren)得到的(de)(de)(de)(de)(de)賠(pei)償(chang)(chang)(chang)不(bu)低于(yu)其依(yi)照(zhao)(zhao)征(zheng)收補(bu)償(chang)(chang)(chang)方(fang)案(an)(an)可(ke)以(yi)獲(huo)(huo)得的(de)(de)(de)(de)(de)征(zheng)收補(bu)償(chang)(chang)(chang)。市、縣人(ren)(ren)(ren)民政府或者土地(di)(di)行(xing)政主管部門(men)既(ji)無征(zheng)收決(jue)定(ding)(ding)又無補(bu)償(chang)(chang)(chang)決(jue)定(ding)(ding)而惡意(yi)(yi)違法(fa)(fa)(fa)強(qiang)制搬遷、嚴重(zhong)損(sun)害被(bei)(bei)(bei)征(zheng)地(di)(di)人(ren)(ren)(ren)合法(fa)(fa)(fa)權益情形的(de)(de)(de)(de)(de),人(ren)(ren)(ren)民法(fa)(fa)(fa)院(yuan)(yuan)除應當依(yi)法(fa)(fa)(fa)判決(jue)賠(pei)償(chang)(chang)(chang)被(bei)(bei)(bei)征(zheng)地(di)(di)農戶(hu)等(deng)(deng)合法(fa)(fa)(fa)財(cai)產損(sun)失和相應銀行(xing)同期貸款(kuan)利息以(yi)外,還可(ke)以(yi)根據《行(xing)政訴訟法(fa)(fa)(fa)》《民事訴訟法(fa)(fa)(fa)》《最高(gao)人(ren)(ren)(ren)民法(fa)(fa)(fa)院(yuan)(yuan)關(guan)于(yu)進(jin)一(yi)步推進(jin)案(an)(an)件繁簡分(fen)流優化司(si)法(fa)(fa)(fa)資源配(pei)置的(de)(de)(de)(de)(de)若干意(yi)(yi)見》(法(fa)(fa)(fa)發(fa)〔2016〕21號)等(deng)(deng)規定(ding)(ding),結(jie)合具(ju)體(ti)情況(kuang),對無過(guo)錯方(fang)提出(chu)的(de)(de)(de)(de)(de)合理的(de)(de)(de)(de)(de)律師費(fei)用等(deng)(deng)正當要求予以(yi)支持。

(四(si))對(dui)違(wei)法強拆后的補救措施

行(xing)(xing)政機關違法強(qiang)(qiang)制拆除被(bei)征(zheng)收(shou)人(ren)(ren)合法房(fang)屋后(hou),應及時通(tong)過協(xie)商(shang)妥善解決(jue)房(fang)屋與房(fang)屋內物品損失;被(bei)征(zheng)收(shou)人(ren)(ren)訴(su)求明顯不符合法律規(gui)定也(ye)無法滿足(zu)的,市、縣人(ren)(ren)民政府(fu)或者土地行(xing)(xing)政主管部門(men)等應當(dang)及時依(yi)法作出書(shu)面(mian)決(jue)定,及時交(jiao)付或者提存相應補(bu)償(賠(pei)償)內容,而不能怠(dai)于(yu)履行(xing)(xing)補(bu)償安置(zhi)職(zhi)責(ze),以(yi)反復協(xie)商(shang)代替書(shu)面(mian)決(jue)定,甚至以(yi)拖(tuo)待變(bian)造成(cheng)安置(zhi)問題長期無法通(tong)過法治化渠道解決(jue)。違法強(qiang)(qiang)制拆除后(hou)不積極補(bu)救且久拖(tuo)不決(jue),既損害(hai)被(bei)征(zheng)收(shou)人(ren)(ren)補(bu)償安置(zhi)權益,又提高補(bu)償安置(zhi)成(cheng)本,還擴大國(guo)家賠(pei)償責(ze)任,損害(hai)政府(fu)依(yi)法行(xing)(xing)政形象,應當(dang)引導行(xing)(xing)政機關盡量避免。

十、其(qi)他涉土地征(zheng)收補償(chang)的(de)相關問題

(一(yi))對預(yu)征(zheng)地協(xie)議的處理

1. 在集(ji)體土地(di)報批征收前,村(cun)民先與村(cun)集(ji)體簽訂預征地(di)協(xie)(xie)議(yi),市、縣人(ren)民政(zheng)府在上(shang)(shang)級行政(zheng)機關未作出征地(di)批復之前也未使(shi)用(yong)土地(di)的,該預征協(xie)(xie)議(yi)因生效(xiao)的條(tiao)件尚未成就,對集(ji)體經(jing)濟組織、被征地(di)農戶(hu)等權利義務尚不產生實際影響,原則上(shang)(shang)不可訴(su)。


2. 預征地協(xie)議生效條件成就后,協(xie)議雙方在履行協(xie)議過程(cheng)中發(fa)(fa)生糾紛(fen)的,應(ying)當參照《中華人(ren)民(min)(min)共(gong)和(he)國民(min)(min)法典(dian)》和(he)《中華人(ren)民(min)(min)共(gong)和(he)國行政訴(su)訟法》確定(ding)相應(ying)的時(shi)效。協(xie)議一(yi)方訴(su)請(qing)解除協(xie)議等的,時(shi)效可(ke)以(yi)自市、縣人(ren)民(min)(min)政府發(fa)(fa)布征地公(gong)告之日起計(ji)算。


3. 在(zai)預征(zheng)地(di)協議(yi)履行(xing)過程中(zhong),集體(ti)(ti)經濟組(zu)織以(yi)及(ji)被征(zheng)地(di)農戶等權利人對(dui)有關行(xing)政主體(ti)(ti)對(dui)協議(yi)涉及(ji)的有關地(di)上附著物數(shu)的調查認(ren)定行(xing)為不服提起行(xing)政訴訟(song)的,人民法(fa)院結(jie)合案(an)件具體(ti)(ti)情況(kuang),可以(yi)立案(an)受理。


(二)土地(di)征收批準文件(征地(di)批復)兩年內未實施的效力問題

《自然(ran)資源部關于(yu)印發〈關于(yu)完善農用(yong)(yong)(yong)地(di)轉(zhuan)用(yong)(yong)(yong)和(he)(he)土(tu)(tu)(tu)地(di)征(zheng)(zheng)收(shou)(shou)審查報(bao)批(pi)工作的(de)意見(jian)〉的(de)通知》(國土(tu)(tu)(tu)資發〔2004〕237號)第十四條(tiao)規定(ding):“農用(yong)(yong)(yong)地(di)轉(zhuan)用(yong)(yong)(yong)和(he)(he)土(tu)(tu)(tu)地(di)征(zheng)(zheng)收(shou)(shou)批(pi)準(zhun)文(wen)件(jian)有效(xiao)期兩年。農用(yong)(yong)(yong)地(di)轉(zhuan)用(yong)(yong)(yong)或(huo)土(tu)(tu)(tu)地(di)征(zheng)(zheng)收(shou)(shou)經依(yi)法(fa)(fa)批(pi)準(zhun)后,市、縣(xian)(xian)兩年內未(wei)用(yong)(yong)(yong)地(di)或(huo)未(wei)實施征(zheng)(zheng)地(di)補償安置(zhi)(zhi)方案的(de),有關批(pi)準(zhun)文(wen)件(jian)自動(dong)失效(xiao)。”據(ju)此,征(zheng)(zheng)地(di)批(pi)復失效(xiao)的(de)前提條(tiao)件(jian)為(wei)(wei)市、縣(xian)(xian)兩年內未(wei)用(yong)(yong)(yong)地(di)或(huo)未(wei)實施征(zheng)(zheng)地(di)補償安置(zhi)(zhi)方案等。因被征(zheng)(zheng)地(di)農戶(hu)等得(de)到征(zheng)(zheng)地(di)補償款(kuan)和(he)(he)具(ju)體獲(huo)得(de)安置(zhi)(zhi),僅為(wei)(wei)市、縣(xian)(xian)人民政(zheng)(zheng)府以(yi)(yi)及(ji)土(tu)(tu)(tu)地(di)行政(zheng)(zheng)主(zhu)管部門具(ju)體實施征(zheng)(zheng)地(di)補償安置(zhi)(zhi)方案的(de)階段性(xing)行政(zheng)(zheng)程序(xu),故不能(neng)僅以(yi)(yi)被征(zheng)(zheng)地(di)農戶(hu)等是(shi)否得(de)到征(zheng)(zheng)地(di)補償款(kuan)和(he)(he)實際獲(huo)得(de)安置(zhi)(zhi),作為(wei)(wei)市、縣(xian)(xian)人民政(zheng)(zheng)府以(yi)(yi)及(ji)土(tu)(tu)(tu)地(di)行政(zheng)(zheng)主(zhu)管部門是(shi)否具(ju)體實施征(zheng)(zheng)地(di)補償安置(zhi)(zhi)方案的(de)依(yi)據(ju)。人民法(fa)(fa)院在具(ju)體司法(fa)(fa)實踐中(zhong),仍(reng)應具(ju)體問(wen)題(ti)具(ju)體分(fen)析。

(三(san))對新農村建設中協(xie)議搬遷的處理

新(xin)農村(cun)建(jian)設中的(de)(de)協(xie)(xie)議搬遷(qian),應(ying)當堅(jian)持村(cun)民(min)(min)自(zi)愿(yuan)原則。在不(bu)改變農村(cun)集(ji)體土(tu)地性質(zhi)的(de)(de)前提下,經上(shang)級人(ren)民(min)(min)政府(fu)批準同意和村(cun)民(min)(min)大會、村(cun)民(min)(min)代表大會審議后,基于新(xin)農村(cun)建(jian)設需要(yao),鄉鎮人(ren)民(min)(min)政府(fu)或者村(cun)委會在平等、自(zi)愿(yuan)、協(xie)(xie)商一致的(de)(de)基礎上(shang)與村(cun)民(min)(min)簽(qian)訂(ding)搬遷(qian)補償(chang)協(xie)(xie)議,人(ren)民(min)(min)法(fa)院(yuan)可以支持。未達成協(xie)(xie)議,村(cun)民(min)(min)未主動交出房屋(wu)(wu)而引發的(de)(de)違法(fa)強制拆除(chu)案件(jian),人(ren)民(min)(min)法(fa)院(yuan)宜通(tong)過協(xie)(xie)調化(hua)解結案,并確保(bao)用于安置的(de)(de)房屋(wu)(wu)標(biao)準不(bu)低于原居住(zhu)房屋(wu)(wu)標(biao)準;無法(fa)協(xie)(xie)調化(hua)解的(de)(de),可以判決鄉鎮人(ren)民(min)(min)政府(fu)或者村(cun)委會依法(fa)承擔相應(ying)的(de)(de)賠償(chang)責任。

(四)對《中華(hua)人(ren)民共(gong)和國土(tu)地(di)管理法》第(di)五十八條第(di)二款(kuan)有關(guan)“適當(dang)補償(chang)”的理解

《中華人(ren)(ren)民共(gong)和國土(tu)地(di)管理法》第五(wu)十八條規(gui)定(ding),為公共(gong)利益需要(yao)使用(yong)(yong)土(tu)地(di)的(de)(de),或者為實施城市(shi)規(gui)劃進(jin)行(xing)舊城區改建(jian),需要(yao)調整使用(yong)(yong)土(tu)地(di)的(de)(de),有(you)(you)關人(ren)(ren)民政(zheng)(zheng)(zheng)府土(tu)地(di)行(xing)政(zheng)(zheng)(zheng)主管部(bu)門(men)報(bao)經原(yuan)批(pi)準用(yong)(yong)地(di)的(de)(de)人(ren)(ren)民政(zheng)(zheng)(zheng)府或者有(you)(you)批(pi)準權(quan)的(de)(de)人(ren)(ren)民政(zheng)(zheng)(zheng)府批(pi)準,可(ke)以收回國有(you)(you)土(tu)地(di)使用(yong)(yong)權(quan),對國有(you)(you)土(tu)地(di)使用(yong)(yong)權(quan)人(ren)(ren)應(ying)當(dang)給(gei)予適(shi)當(dang)補償(chang)。土(tu)地(di)使用(yong)(yong)權(quan)人(ren)(ren)不服的(de)(de),一(yi)般應(ying)當(dang)以作(zuo)出收回土(tu)地(di)決定(ding)的(de)(de)土(tu)地(di)行(xing)政(zheng)(zheng)(zheng)主管部(bu)門(men)為被告。

土(tu)地行(xing)(xing)政主管部門(men)可以在(zai)作(zuo)出收(shou)回(hui)土(tu)地決定時一并補償,也可另行(xing)(xing)作(zuo)出補償決定書。對(dui)收(shou)回(hui)的(de)國有土(tu)地的(de)“適(shi)當(dang)(dang)補償”也即公平合(he)理(li)補償。原(yuan)則上應(ying)當(dang)(dang)按照《城鎮(zhen)土(tu)地估(gu)(gu)價規(gui)程》通過評(ping)估(gu)(gu)來確定被(bei)收(shou)回(hui)國有土(tu)地的(de)市場(chang)價值。對(dui)于(yu)行(xing)(xing)政機關作(zuo)為補償決定依(yi)據的(de)評(ping)估(gu)(gu)報告(gao),人民法(fa)院可以對(dui)作(zuo)出評(ping)估(gu)(gu)報告(gao)的(de)程序、評(ping)估(gu)(gu)方法(fa)等(deng)(deng)是否合(he)法(fa)進行(xing)(xing)審查。評(ping)估(gu)(gu)方法(fa)的(de)確定應(ying)當(dang)(dang)依(yi)法(fa)在(zai)收(shou)益還原(yuan)法(fa)、市場(chang)比較法(fa)、成本逼近法(fa)、剩余(yu)法(fa)、基準地價系數修(xiu)正法(fa)等(deng)(deng)中科學合(he)理(li)選擇(ze),既(ji)應(ying)考慮(lv)自然資源部的(de)技術(shu)規(gui)范,也應(ying)考慮(lv)案件所涉土(tu)地使(shi)用(yong)權的(de)使(shi)用(yong)現狀以及收(shou)回(hui)國有土(tu)地使(shi)用(yong)權的(de)目(mu)的(de)和(he)用(yong)途。
